Gustavo Delgado leads the Public Law and Litigation departments of PAGBAM SCHWENCKE Chile.
He focuses his practice in arbitration and litigation proceedings, public procurement matters, administrative law penalties, State liability cases, contentious-administrative proceedings and constitutional claims.
He frequently advises clients from mining and natural resources industry.
He usually appears before arbitral tribunals, ordinary courts, Courts of Appeals, the Supreme Court, the Constitutional Court, and Public Administration bodies.
Education
Gustavo Delgado obtained a law degree from the Pontificia Universidad Católica de Chile in 2012. He was sworn as a barrister by the Chilean Supreme Court in 2013.
In 2018 he completed a Post-Graduate Diploma in Administrative Litigation in the Pontificia Universidad Católica de Chile.
Academic & Professional Experience
Mr. Delgado joined PAGBAM SCHWENCKE Chile in 2020. Before, he worked as an associate of the Dispute Resolution and Public Law departments of Aninat, Schwencke & Cía. (2017-2020) and Baker McKenzie Chile (2014-2017). Between 2012 and 2014 he served as legal advisor to the Head of the Legal Division of the Chilean Ministry of Education.
He was appointed Professor of Public Law Advisory in the Faculty of Law of the Pontificia Universidad Católica de Chile in 2019, teaching a core course of the undergraduate programme since that time. Before, he served as a teaching assistant of Constitutional Law and Administrative Law in the same faculty.
Among other works, he is co-author of “Justiciabilidad del derecho al olvido en Chile: Una propuesta a partir de la jurisprudencia de la Corte Suprema en casos sobre informaciones relacionadas con procesos penales” (Justiciability of the right to be forgotten in Chile: A proposal based on the jurisprudence of the Supreme Court in cases involving information related to criminal proceedings), chapter 15 of the book “Justicia Penal Pública y Medios de Comunicación” (Criminal Justice and Media), published by Tirant lo Blanch (Spain, 2018).
He is also author of the paper “Algunas consideraciones acerca de la presunción de legalidad de los actos administrativos en el contencioso-administrativo de nulidad y responsabilidad patrimonial” (Some considerations about the presumption of legality of administrative acts in the contentious-administrative proceedings of nullity and patrimonial liability of the State), published in the journal Ius Publicum (volume 42, March 2019, Universidad Santo Tomás, Chile).
