Impuesto sobre los Bienes Personales: El BCRA dispone que la repatriación de activos financieros deberá acreditarse en una cuenta bancaria especial habilitada a ese único fin. 

El 12 de febrero de 2020 se publicó en el Boletín Oficial la Comunicación A (BCRA) 6893 (en adelante, la “Comunicación”), que fue dictada el pasado el 7 de febrero por el Banco Central de la República Argentina (BCRA) .

Dicha norma dispone que en los casos en los que los contribuyentes decidan repatriar sus activos financieros en los términos de la Ley de Solidaridad Social y sus decretos reglamentarios, los montos repatriados deberán ser acreditados en cuentas que las entidades financieras habiliten a ese único fin, que serán denominadas “Caja de ahorros repatriación de fondos - bienes personales Ley 27541”. 

La Comunicación también establece que los fondos que se depositen en dichas cuentas especiales se mantendrán en la moneda extranjera en la que se hubiera efectuado la repatriación, y deberán provenir de cuentas abiertas en el exterior cuyo titular sea el contribuyente declarante de la repatriación y titular de la cuenta local. 

Por último, la Comunicación ordena a las entidades financieras que reciban los fondos repatriados a comunicar a AFIP los débitos que se efectúen de dichas cuentas, sin interrumpir los plazos que AFIP establezca para el caso de constitución o renovación de plazos fijos con fondos acreditados en estas cuentas especiales. 

Sobre esta cuestión, recordamos que a través del Decreto N° 116/2020 se habilitó la posibilidad de afectar los fondos repatriados a determinados destinos o inversiones (entre ellos, plazos fijos y venta en el mercado único y libre de cambios).

On February 12, 2020, Communication A (BCRA) 6893 (the "Communication"), issued by the Central Bank of Argentina on February 7, 2020, was published in the Official Gazette.

The Communication provides that in cases where taxpayers decide to repatriate their financial assets under the terms of the Social Solidarity Law and its regulatory decrees, the repatriated funds must be deposited in accounts that financial entities must open for that sole purpose, named “Saving account repatriation of funds - Personal Assets Law No. 27,541”.

The Communication also states that the funds deposited in such special accounts will be kept in the foreign currency in which the repatriation took place, and must be transferred from foreign accounts of the taxpayer reporting the repatriation to the special bank account open in his name. 

Finally, the Communication orders the financial institutions receiving the repatriated funds to inform Argentina’s Tax Authority (AFIP) of any debits made from these accounts, without interrupting the deadlines set by AFIP for the establishment or renewal of time deposits with funds deposited in these special accounts.

On this issue, we recall that Decree No. 116/2020 granted taxpayers the possibility of affecting the repatriated funds to certain destinations or investments (including the establishment of time deposits and their sale in the exchange market).
