Protocolo para la comercialización de sustancias activas y productos fitosanitarios

El 14 de mayo de 2021 se publicó en el Boletín Oficial la Resolución Nº 245/2021 del Servicio Nacional de Sanidad y Calidad Agroalimentaria (la “Resolución” y “SENASA”, respectivamente), por medio de la cual se aprueba el Protocolo para la comercialización de sustancias activas y productos fitosanitarios en todo el territorio nacional (el “Protocolo” y los “Productos”, respectivamente).

El Protocolo establece los requisitos mínimos que deben cumplir los envases y embalajes que contengan los Productos de uso agrícola y línea jardín, así como las condiciones para su comercialización y distribución de envases retornables y granel.

En ese sentido, establece que los envases y embalajes de Productos a ser usados y comercializados en Argentina deben certificar/homologar un prototipo de envase a fin de garantizar condiciones de calidad tales que aseguren una protección contra el deterioro del producto, probada resistencia al impacto, el almacenamiento, el apilamiento y la manipulación durante el transporte y utilización del producto.

Asimismo, se indica que en el momento de la inscripción de los Productos de uso agrícola y línea jardín, el registrante deberá adjuntar una declaración jurada, declarando tipo, material y capacidad de los envases y embalajes con los que planifica comercializar dichos Productos. Para obtener el certificado de inscripción, el registrante deberá incorporar el Certificado de Homologación del Prototipo de los Envases que finalmente se comercialicen (el “Certificado”).

El Protocolo aclara que la comercialización de Productos en Recipientes Intermedios para Graneles (RIG) retornables de capacidades de entre 200 y 1.000 litros debe ser solicitada por la firma registrante y para cada producto a comercializar. Asimismo, deberán presentar un sistema integrado de gestión informático que debe ser aprobado de manera previa a su implementación.

Por otra parte, el Protocolo indica que la comercialización de Productos a granel también debe ser solicitada expresamente por la firma registrante para su evaluación y autorización expresa identificando el producto que comercializará bajo esta modalidad. En este caso, el registrante también deberá presentar un sistema integrado de gestión informático, que permita visualizar y fiscalizar de manera remota y en tiempo real todas las transacciones, y que debe ser aprobado de manera previa a su implementación.

Finalmente, el Protocolo estipula ciertos requisitos que deben observar la planta formuladora, la unidad de transporte, la planta fraccionadora y el usuario final de Productos a granel.

La Resolución deroga la Disposición Nº 11/1985 del ex Servicio Nacional de Calidad Vegetal.

La Resolución entrará en vigencia a los 60 días corridos de su publicación en el Boletín Oficial (esto es, a partir del 13 de julio de 2021). No obstante, el Protocolo establece que los Productos ya registrados, y los que a futuro se inscriban, cuentan con un plazo máximo de 3 años, para incorporar al expediente el Certificado.

Protocol for the commercialization of active substances and phytosanitary products

On May 14, 2021, Resolution No. 245/2021 of the National Food Health and Quality Agency (the “Resolution” and “SENASA”, respectively) was published in the Official Gazette. The Resolution passes the Protocol for the commercialization of active substances and phytosanitary products throughout the national territory (the “Protocol” and the “Products”, respectively).

The Protocol establishes the minimum requirements that the containers and packaging containing the Products for agricultural or garden use must meet, as well as the conditions for their commercialization and distribution in returnable packages and in bulk.

In this sense, it establishes that the containers and packaging of Products to be used and marketed in Argentina must certify a container prototype in order to guarantee quality conditions that ensure protection against product deterioration, proven impact resistance, storage, stacking and handling during transportation and use of the product.

Likewise, it is indicated that at the time of registration of the Products for agricultural or garden use, the registrant must attach an affidavit, stating the type, material and capacity of the containers and packaging with which he/she plans to market the Products. To obtain the registration certificate, the registrant will have to attach the Certificate of Homologation of the Container Prototype that will be finally used to market the Products  (the “Certificate”).

The Protocol clarifies that the marketing of Products in returnable Intermediate Bulk Containers (IBC) with capacities of between 200 and 1,000 liters must be requested by the registrant and for each product to be marketed. Likewise, he/she must submit an integrated computer management system that must be approved prior to its implementation.

On the other hand, the Protocol indicates that the commercialization of bulk Products must also be expressly requested by the registrant for its analysis and authorization, identifying the product that will be commercialized under this modality. In this case, the registrant must submit an integrated computer management system as well, that allows all transactions to be audited remotely and in real time, and which must be approved prior to its implementation.

Finally, the Protocol states certain requirements that must be fulfilled by the formulating plant, the transport unit, the fractionating plant and the end user of bulk Products.

The Resolution repeals Disposition No. 11/1985 of the former National Plant Quality Agency.

The Resolution will enter into force 60 calendar days after its publication in the Official Gazette (that is, as of July 13, 2021). However, the Protocol establishes that the Products already registered, and those that will be registered in the future, have a maximum period of 3 years to attach the Certificate into the file.
