Senado aprueba reforma al Código de Aguas 

El 12 de enero de 2022, tras diez años de tramitación legislativa, el Senado aprobó de forma unánime una reforma extensiva al Código de Aguas. El proyecto aprobado fue enviado al Presidente de la República para su promulgación y posterior publicación en el Diario Oficial como ley de la República.

Entre las principales novedades del proyecto se cuentan las siguientes:

  • Se reconoce expresamente el acceso al agua y su saneamiento como un derecho humano esencial e irrenunciable.
     
  • Los nuevos derechos de aprovechamiento de agua que se concedan tendrán una duración de 30 años, salvo que la autoridad administrativa determine un plazo menor por resolución fundada. Dicho plazo se renovará automáticamente, salvo que la autoridad administrativa acredite su no uso o que exista afectación a la fuente subterránea o superficial.
     
  • Los derechos de aprovechamiento de agua se extinguirán por su no uso durante 5 años en el caso derechos consuntivos y durante 10 años tratándose de derechos no consuntivos. 
     
  • Se extinguirán los derechos de aprovechamiento de agua no inscritos en el Registro de Aguas del Conservador correspondiente dentro del plazo de 18 meses desde la publicación de la ley.
     
  • Se incorporan modificaciones al régimen de patentes por no uso, aumentando los factores para la determinación del monto de las patentes; cambiando las exenciones al pago de ésta; incorporando recargos por atrasos en su pago; y modificaciones al procedimiento de remate.

Senate passes reform to the Water Code 

On January 12, 2022, after ten years of legislative processing, the Senate unanimously approved an extensive reform to the Water Code. The passed project was sent to the President for its promulgation and subsequent publication in the Official Gazette.

The main innovations of this project are the following: 

  • Access to water and its sanitation is expressly recognized as an essential and inalienable human right. 
     
  • The new water use rights granted will last 30 years unless the administrative authority determines a shorter term by founded resolution. The duration of the rights will be renewed automatically unless the administrative authority proves its non-use or that there is an affectation to the underground or surface source.
     
  • The water use rights will be extinguished for not using them in 5 years in the case of “consumptive” rights (those which allow to use the water without giving it back to the source) and for 10 years in the case of “non-consumptive” rights (those which force the user to give the water back to its source once used). 
     
  • The water use rights not registered in the Registry of Waters of the corresponding Conservator will be extinguished within a period of 18 months from the publication of the law. 
     
  • Modifications to the patent regime for non-use are incorporated, increasing the factors for determining the amount of the patents; changing the exemptions to the payment of the patents; incorporating surcharges for delays in the payment; and modifying the auction procedure.
