Ley N° 21.431 regula el contrato de trabajadores de empresas de plataformas digitales de servicios 

El 11 de marzo de 2022 se publicó la Ley N° 21.431 (la “Ley”) que regula la prestación de servicios de trabajadores de empresas de plataformas digitales, la que entrará en vigencia el próximo 1 de septiembre de 2022. 

La Ley define como “Empresa de plataforma digital de servicios” a aquella organización que, a título oneroso, administra o gestiona un sistema informático o de tecnología ejecutable en aplicaciones de dispositivos móviles o fijos que permite que un trabajador de plataformas digitales ejecute servicios, para los usuarios de dicho sistema informático o tecnológico, en un territorio geográfico específico, tales como el retiro, distribución y/o reparto de bienes o mercaderías, el transporte menor de pasajeros, u otros.

En cuanto a los trabajadores, la Ley distingue entre trabajadores de plataformas digitales dependientes, aquellos que prestan servicios bajo subordinación y dependencia, e independientes, quienes no se encuentran sujetos al artículo 7 del Código del Trabajo, estableciendo normas especiales para cada caso. 

Sin perjuicio de la distinción, la Ley regula las normas comunes a ambos tipos de trabajadores de plataformas digitales. Entre las normas comunes más destacadas se encuentran el derecho de ambos tipos de trabajadores a recibir el pago de indemnizaciones por término de contrato, constituir sindicatos y negociar colectivamente, y la aplicación del procedimiento de tutela laboral.

Law No. 21,431 regulates the contract between workers and digital services platform companies

Law No. 21,431 (the “Law”), published on March 11, 2022, regulates the provision of services by workers of digital platform companies. It will come into force on September 1, 2022.

The Law defines “Digital Service Platform Company” as that organization that, for valuable consideration, administers or manages a computer  or technology system that can be executed in mobile or fixed device applications that allows a digital platform worker to execute services, for the users of said computer or technological system, in a specific geographical territory, such as the withdrawal and/or distribution of goods or merchandise, the minor transport of passengers, or others.

As for workers, the Law distinguishes between dependent digital platform workers, those who provide services under subordination and dependency, and independents, who are not subject to Section 7 of the Labor Code, establishing special rules for each case.

Despite the distinction, the Law regulates the rules common to both types of digital platform workers. Some of the most outstanding common dispositions are the right of both types of workers to receive severance pay for the termination of their contract, form unions and collective bargaining, and the application of the labor protection procedure.
