Se disuelve la Administración Federal de Ingresos Públicos (AFIP), se crea la Agencia de Recaudación y Control Aduanero (ARCA) y se designan sus autoridades

El 25 de octubre de 2024 se publicó en el Boletín Oficial el Decreto N° 953/2024 (el “Decreto”), mediante el cual se disuelve la Administración Federal de Ingresos Públicos (“AFIP”) y se crea la Agencia de Recaudación y Control Aduanero (“ARCA”). 

Entre las cuestiones más relevantes del Decreto, se destacan las siguientes: 

  • Se establece que la ARCA estará a cargo de un Director Ejecutivo, que será designado por el Poder Ejecutivo Nacional. La duración de su mandato será de 4 años, pudiendo ser designado por sucesivos períodos.
  • Se transfiere a la ARCA los recursos, el personal, los bienes, el presupuesto vigente, los activos y el patrimonio, compromisos, derechos y obligaciones de la AFIP.
  • La ARCA es la continuadora jurídica y mantendrá las responsabilidades, competencias y funciones asignadas a la AFIP hasta la fecha de publicación de las normas y la estructura orgánica y funcional del Decreto.
  • Las referencias que los convenios y acuerdos suscriptos, o las contrataciones en curso, hagan a la AFIP o sus unidades dependientes, su competencia o sus autoridades, se considerarán hechas a la ARCA.
  • A los efectos tributarios, bancarios y de funcionamiento interno que se vinculen con la recaudación y distribución de los fondos a cargo de la ARCA, y a la normal operación del organismo, la ARCA se identificará tributariamente con la Clave Única de Identificación Tributaria de la AFIP.
Por otro lado, a través del Decreto Nº 954/2024 publicado el 25 de octubre de 2024 en el Boletín Oficial, se designa a la abogada Florencia Lucila Misrahi en el cargo de Directora Ejecutiva de la ARCA desde el 24 de octubre de 2024.

Además, se designa a cargo de la Dirección General Impositiva (DGI) a Andrés Edgardo Vázquez, y de la Dirección General de Aduanas (DGA), a Andrés Velis.

Ambos decretos entraron en vigencia el día de su publicación en el Boletín Oficial.

The Argentine Federal Tax Authority (AFIP) is dissolved, the Tax Collection and Customs Control Agency (ARCA) is created, and its authorities are appointed

Decree No. 953/2024 (the “Decree”) published in the Official Gazette on October  25, 2024, dissolved the Argentine Federal Tax Authority (“AFIP’, after its Spanish acronym) and creates the Tax Collection and Customs Control Agency (“ARCA”, after its Spanish acronym). 

The following are the most relevant matters regulated by the Decree:

  • It establishes that the ARCA will be headed by an Executive Director, who will be appointed by the National Executive Branch. The duration of the mandate will be 4 years, and the Executive Director may be appointed for successive periods.
  • AFIP’s resources, staff, property, current budget, and assets, commitments, rights and obligations are transferred to the ARCA.
  • The ARCA is the legal successor and will have the responsibilities, competences and functions assigned to the AFIP.
  • The agreements, and the ongoing contracts referring to the AFIP shall be deemed to be making reference to the ARCA.
  • For tax, banking and internal operational purposes related to the collection and allocation of funds managed by the ARCA, it shall be identified for tax purposes with the AFIP’s Tax Identification Code.
By means of Decree No. 954/2024, published in the Official Gazette on October  25, 2024, the attorney Florencia Lucila Misrahi is appointed to the position of Executive Director of the ARCA as from October 24, 2024. 

Additionally, Andrés Edgardo Vázquez is appointed as the head of the General Tax Directorate (DGI, after its Spanish acronym), and Andrés Velis is appointed as the head of the General Customs Directorate (DGA, after its Spanish acronym).

Both decrees became effective on the day of their publication in the Official Gazette.
