Modifications to the Mining Investment Regime

Modificaciones al Régimen de Inversiones Mineras
|
Through Decree No. 449/2025, the Executive Branch amended Laws No. 24,196 and 24,466 to streamline mining regulations and enhance geological data management.
Key aspects of the modifications:
- Fiscal Stability Certificate (Art. 10): Now only requires the date of the feasibility study submission, eliminating the need to list all applicable taxes.
- Annual Affidavit (Art. 18): Beneficiaries must submit yearly investment details with an independent technical report to improve oversight.
- Verification (Art. 26): The Authority will verify compliance based on the affidavit and technical report.
- Geological Info (Art. 27): Surface data will now be managed by SEGEMAR, replacing the previous system under the Mining Department.
- Law 24,466 Update: The National Geological Information Bank will operate under SEGEMAR to avoid overlapping functions.
- Effective Date: from July 7, 2025, including ongoing proceedings.

A través del Decreto N.º 449/2025, el Poder Ejecutivo modificó las Leyes N.º 24.196 y 24.466 con el objetivo de simplificar la normativa minera y optimizar la gestión de la información geológica.
Aspectos clave de las modificaciones:
- Certificado de Estabilidad Fiscal (Art. 10): Sólo deberá consignarse la fecha de presentación del estudio de factibilidad, eliminándose la obligación de detallar los tributos aplicables.
- Declaración Jurada Anual (Art. 18): Los beneficiarios deberán presentar anualmente una declaración con el detalle de las inversiones realizadas, acompañada de un informe técnico independiente, a fin de mejorar el control y reducir demoras administrativas.
- Verificación (Art. 26): La Autoridad de Aplicación verificará el cumplimiento de los compromisos asumidos en base a la declaración jurada y el informe técnico correspondiente.
- Información Geológica (Art. 27): Los datos de superficie registrados serán gestionados por SEGEMAR, reemplazando al sistema anterior a cargo de la Dirección de Minería.
- Modificación de la Ley 24.466: El Banco Nacional de Información Geológica funcionará bajo la órbita de SEGEMAR, evitando superposiciones funcionales.
- Fecha de entrada en vigencia: 7 de julio de 2025, incluyendo los trámites en curso a esa fecha.

Nuevo régimen promocional en Salta
|
The Province of Salta has announced a transitional promotional regime that reduces the service fees applicable to mining activities. The measure - enacted through Emergency Decree No. 244/2024 - will remain in force until December 31, 2026, with the possibility of a one-year extension.
The initiative aims to reduce administrative costs related to mining procedures, reactivate exploration activities, attract genuine investment, and maintain competitiveness with other jurisdictions.

La provincia de Salta anunció un régimen promocional transitorio que reduce las tasas retributivas aplicables a la actividad minera. La medida - establecida por el DNU N.º 244/2024 - estará vigente hasta el 31/12/2026, prorrogable por un año.
La iniciativa busca reducir los costos administrativos asociados a trámites mineros, reactivar la exploración minera, atraer inversiones reales y mantener la competitividad frente a otras jurisdicciones.
