Concession of the Comahue hydroelectric power plants: authorization and bidding documents

On August 19th, the National Executive Branch issued Decree No. 590/25. With this measure, the National Government authorized the transfer of the shares held by Energía Argentina S.A. in Alicurá, El Chocón, Cerros Colorados, and Piedra del Águila to the Energy Secretariat of the Ministry of Economy, for their subsequent sale.
The Decree No. 590/2025 was issued, according to its fundamentals, after identifying a material error in the Decree No. 564/2025 informed in our August 2025 edition of What's New in Argentina. Accordingly, Decree No. 590/2025 was issued after noting that in the issuance of Decree No. 564/2025 the mandatory Detailed Report (Informe Circunstanciado), a prerequisite for authorizing the privatization, lacked the signature of the corresponding authority in the official file.
Today, the National Government continues to pursue the sale of the shares described above and, through Resolution No. 1200/2025, the Ministry of Economy approved the Bidding Documents (Pliegos de Bases y Condiciones) and officially initiated the National and International Public Tender for the sale of the entire share package of Alicurá S.A., El Chocón S.A., Cerros Colorados S.A., and Piedra del Águila S.A.
According to the Resolution, the procedure will be carried out electronically through the CONTRAT.AR platform. Key dates for the tender process have been set as follows, all via the said platform:
- Inquiries: the submission of inquiries regarding the Bidding Documents is set to be until 5:00 PM on October 13, 2025.
- Bid Submission: the deadline to submit the offers is at 4:00 PM on October 23, 2025.
- Public Bid Opening: the opening of offers will be conducted as a public act, scheduled for 5:00 PM on October 23, 2025.

Privatization of Argentina’s Water and Wastewater Company (AySA)

Through Resolution No. 1198/2025, the National Government initiated the privatization process of the state-owned company Agua y Saneamientos Argentinos S.A. (AySA), under the terms of Decree No. 494/2025 informed in our July 2025 edition of What's New in Argentina.
The process will be supervised by the Public Enterprises Transformation Agency, an entity under the purview of the Ministry of Economy.
The Public Enterprise Transformation Agency was instructed to coordinate the necessary actions to comply with the provisions of Chapter II of Annex I to Decree 695 of August 2, 2024, in order to:
a) Engage a banking institution within the National Public Sector to assess the share package of AySA.
b) Complete the sale referred in subsection a) of Article 2 of Decree No. 494/2025, within eight (8) months from the effective date of this measure. This will be carried out through the Contrat.ar platform.
c) Take the necessary measures and actions for the sale on the country's stock exchanges and markets of the remaining shares owned by the National Government in AySA that have not been sold in accordance with the provisions of subsection a) of Article 2 of Decree No. 494/2025.
The Secretariat of Public Works of the Ministry of Economy was also instructed to:
a) Prepare the technical and contractual bidding documentation for the privatization process of AySA, which will include the corresponding concession contract.
b) Coordinate the necessary actions to comply with the provisions of Article 3 of Decree No. 494/2025.
