La Secretaría de Minería establece pautas de auditoría y fiscalización para el Régimen de Inversiones Mineras
El 25 de marzo de 2026 se publicó en el Boletín Oficial la Resolución N° 21/2026 (la “Resolución”), mediante la cual la Secretaría de Minería aprobó el “Manual de Procedimientos de Auditoría” del Régimen de Inversiones Mineras (Ley N° 24.196) estableciendo criterios operativos y metodológicos para que las tareas de fiscalización se realicen de manera objetiva y uniforme.
La Resolución busca optimizar el uso de recursos y asegurar que los beneficios fiscales y de importación otorgados por el régimen se utilicen correctamente.
Los resultados de las fiscalizaciones se utilizarán como “inteligencia de datos” para proponer futuras mejoras en la normativa del sector.
Se faculta a la Dirección Nacional de Inversiones Mineras a elaborar un plan anual de auditorías para implementar este nuevo manual.
La Resolución entró en vigor el 26 de marzo de 2026 y resulta aplicable incluso a los procedimientos de control que se encuentren actualmente en curso.

The Federal Department of Mining establishes audit and oversight guidelines for the Mining Investment Regime
On March 25, 2026, Resolution No. 21/2026 (the “Resolution”) was published in the Official Gazette, by means of which the Federal Department of Mining approved the “Audit Procedures Manual” of the Mining Investment Regime (Law No. 24,196), establishing operational and methodological criteria so that oversight tasks are carried out in an objective and uniform manner.
The Resolution seeks to optimize the use of resources and ensure that the tax and import benefits granted by the regime are correctly utilized.
The results of the audits will be used as “data intelligence” to propose future improvements to the sector's regulations.
The National Directorate of Mining Investments is authorized to develop an annual audit plan to implement this new manual.
The Resolution entered into force on March 26, 2026, and is applicable even to oversight procedures that are currently ongoing.
