Entran en vigencia las nuevas Reglas de Arbitraje de la Cámara de Comercio Internacional

Las nuevas Reglas de Arbitraje de la Cámara de Comercio Internacional (“ICC”) se aplicarán a los procedimientos que se inicien desde el 1 de junio de 2026. Algunos de los cambios más significativos son los siguientes:

  • Reemplazo del Acta de Misión: Se elimina el tradicional paso de redactar y firmar los Terms of Reference. Ahora, la gestión se centrará en una Conferencia inicial de Gestión del Caso (“CMC”), que el tribunal deberá celebrar dentro de los 30 días posteriores a recibir el expediente.
  • Desestimación anticipada: Se incorpora la posibilidad de que cualquier parte solicite al tribunal la determinación anticipada de demandas o defensas bajo el argumento de que carecen manifiestamente de mérito o que escapan manifiestamente a la jurisdicción del tribunal.
  • Nuevo Arbitraje “Altamente Acelerado”: Para los casos que requieran máxima celeridad, se incorpora un procedimiento ultra rápido (Apéndice VI), con las siguientes características: (a) requiere acuerdo de partes; (b) será resuelto por un árbitro único; (c) el tribunal deberá emitir su laudo final en un plazo máximo de tres meses desde la CMC inicial; y (d) no se permitirá la incorporación de otras partes.
  • Ampliación del procedimiento abreviado: Para los acuerdos de arbitraje celebrados a partir del 1 de junio de 2026, el umbral económico de aplicación automática se eleva a USD 4.000.000.
  • Digitalización por defecto: La norma general establece que las comunicaciones escritas con la Secretaría se realizarán por correo electrónico o medios electrónicos que generen un registro. Las presentaciones en formato físico quedan reservadas únicamente para cuando se requiera transmisión contra recibo o si la vía electrónica no es factible. Se faculta expresamente a los tribunales arbitrales para firmar los laudos de manera electrónica.
  • Transparencia. Financiación de terceros: Se mantiene y reitera la obligación de informar sin demora a la Secretaría, al tribunal y a las demás partes sobre la existencia e identidad de cualquier tercero que financie las reclamaciones o defensas.

New Arbitration Rules of the International Chamber of Commerce enter into force

The new Arbitration Rules of the International Chamber of Commerce (“ICC”) will apply to proceedings initiated as from June 1, 2026. Some of the most significant changes are the following:

  • Replacement of the Terms of Reference: The traditional step of drawing up and signing the Terms of Reference is eliminated. Now, case management will focus on an initial case management conference (“CMC”), which the arbitral tribunal must hold within 30 days from receiving the file. 
  • Early Determination: It introduces the possibility for any party to apply to the arbitral tribunal for the early determination of one or more claims or defenses on the grounds that they are manifestly without merit or manifestly outside the arbitral tribunal’s jurisdiction.
  • New “Highly Expedited Arbitration”: For cases requiring maximum speed, an ultra-fast procedure is introduced (Appendix VI), with the following characteristics: (a) it requires the agreement of the parties; (b) it will be decided by a sole arbitrator; (c) the arbitral tribunal must render its final award within three months from the date of the initial CMC; and (d) the joinder of additional parties is not permitted.
  • Expansion of the Expedited Procedure: For arbitration agreements concluded on or after June 1, 2026, the automatic application threshold is increased to USD 4,000,000.
  • Default digitalization: The general rule establishes that written communications with the Secretariat shall be made by email or other means of electronic communication that creates a record. Hard copy submissions are reserved only for when transmission against receipt is requested or if electronic transmission is not practicable.  Arbitral tribunals are expressly authorized to sign the award electronically.
  • Transparency and Third-Party Funding: The obligation to promptly inform the Secretariat, the arbitral tribunal, and the other parties of the existence and identity of any non-party that funds claims or defenses is maintained and reiterated.
