El Poder Ejecutivo Nacional promulga la Ley N° 21.822 para incentivar la contratación activa y permanencia de trabajadores mayores de 60 años

El 1 de junio de 2026 se publicó en el Diario Oficial la Ley N° 21.822 (la “Ley”) que, entre otros aspectos, establece importantes modificaciones al Código del Trabajo con el fin de promover la empleabilidad y permanencia laboral de personas de 60 años o más.


En específico, la Ley incorpora un nuevo capítulo al Código del Trabajo que regula el contrato de trabajo de la persona mayor, el cual contempla condiciones de trabajo más flexibles y adaptadas a las necesidades de dicho grupo etario.

Entre los aspectos más relevantes de este régimen especial de contratación para personas mayores destacamos:

  • Flexibilidad de jornada a través de bandas horarias o libre elección total de la distribución, bajo ciertas condiciones.
  • Uso anticipado y proporcional del feriado anual desde los siete meses de iniciada la relación laboral.
  • Suspensión convencional del contrato sin afectar la antigüedad ni derechos del trabajador y asegurando el reintegro en condiciones no inferiores a las pactadas previo a la suspensión.
  • Exigencia de compatibilidad entre funciones pactadas y la salud del trabajador.
Las referidas modificaciones establecidas por la Ley entrarán en vigor el 1 de junio de 2027.

The Executive Branch enacts Law No. 21,822 to foster the hiring and retention of employees aged 60 and older

On June 1, 2026, Law No. 21,822 (the “Law”) was published in the Official Gazette. Among other matters, the Law introduces significant amendments to the Labor Code aimed at promoting the employability and workforce participation of individuals aged 60 and older.

Specifically, the law incorporates a new chapter into the Labor Code regulating employment contracts for older employees, which provides for more flexible working conditions tailored to the needs of this age group.

Among the most relevant aspects of this special employment regime for older employees, we highlight:

  • Flexible work hours through time bands or complete freedom to choose the schedule, under certain conditions.
  • Early and proportional use of annual leave starting seven months after the employment relationship begins.
  • Contract suspension without affecting the employee’s seniority or rights and ensuring reinstatement under conditions no less favorable than those agreed upon prior to the suspension.
  • Mandatory compatibility between agreed duties and the employee’s health.
The amendments will take effect as of June 1, 2027.
