Nueva ley establece incrementos retroactivos en el ingreso mínimo mensual

La Ley N° 21.830 fue publicada en el Diario Oficial el pasado 22 de junio de 2026 y establece que, a partir del 1 de mayo de 2026, entrarán en vigor los siguientes incrementos:

  1. El ingreso mínimo mensual para trabajadores mayores de 18 y hasta 65 años, ascenderá a la suma de $553.553 (USD 615 aprox.). Como consecuencia de este aumento, la gratificación legal que se pague de conformidad al artículo 50 del Código del Trabajo (4,75 IMM), se verá incrementada. La referida ley también contempla un reajuste conforme a la variación acumulada por el Índice de Precios al Consumidor (IPC), a contar del 1 de enero de 2027.
  2. El ingreso mínimo mensual para trabajadores menores de 18 años y mayores de 65 años, ascenderá a la suma de $412.938 (USD 458 aprox.).
  3. El ingreso mínimo mensual para efectos no remuneracionales ascenderá a la suma de $356.815 (USD 396 aprox.).
Atendido a que el incremento del ingreso mínimo mensual rige de manera retroactiva, se debe reliquidar cualquier diferencia que pudiera haberse producido en las remuneraciones y, de manera especial, en la gratificación legal que se pague mensualmente según la modalidad dispuesta en el artículo 50 del Código del Trabajo.

New law establishes retroactive increases to the monthly minimum wage

Law No. 21,830 was published in the Official Gazette on June 22, 2026, establishing that, effective as of May 1, 2026, the following increases will come into effect:

  1. The monthly minimum wage for employees over 18 and up to 65 years of age will increase to CLP $553,553 (USD 615 approx.). As a result of this rise, the legal bonus paid in accordance with article 50 of the Labor Code (4.75 monthly minimum wage) will experience an increase. The aforementioned law also provides for an adjustment based on the accumulated variation of the Consumer Price Index (IPC), effective as of January 1, 2027.
  2. The monthly minimum wage for employees under 18 and over 65 years of age will increase to CLP $412,938 (USD 458 approx.).
  3. The monthly minimum wage applicable for non-remunerational purposes will increase to CLP 356,815 (USD 396 approx.).
Given that the increase in the minimum monthly wage is effective retroactively, any difference that may have arisen in wages must be adjusted, particularly with regard to the legal bonus paid monthly in accordance with article 50 of the Labor Code.
