Se prórroga el plazo para adherir al Régimen Simplificado de Extinción de Obligaciones de Contratos de Obra Pública

El 17 de julio de 2026 se publicó en el Boletín Oficial la Resolución N° 2/2026 de la Secretaría de Coordinación de Infraestructura de la Nación, por medio de la cual se resolvió extender el plazo para que los contratistas de obra pública puedan solicitar su adhesión al “Régimen Simplificado de Extinción de Obligaciones de Contratos de Obra Pública” (el “Régimen”), establecido por la Resolución N° 1/2026, informado en la edición del 8 de julio de 2026 de nuestro Alerta de Novedades Legales.


La nueva fecha límite para solicitar la adhesión al Régimen es el 23 de julio de 2026.

The deadline to adhere to the Simplified Regime for the Extinction of Obligations in Public Works Contracts is extended

On July 17, 2026, Resolution No. 2/2026 of the Federal Department of Infrastructure Coordination was published in the Official Gazette, extending the deadline for contractors of public works contracts to request their adherence to the “Simplified Regime for the Extinction of Obligations in Public Works Contracts” (the “Regime”), established by Resolution No. 1/2026, which was informed in the July, 8 of our Legal News Alert.


The new deadline to request adherence to the Regime is July 23, 2026.

El Poder Ejecutivo reglamenta la base de cálculo de las contribuciones en Convenios Colectivos

El 20 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia el Decreto N° 612/2026, que complementa el Decreto N° 407/2026 al disponer que la base de cálculo para los aportes y contribuciones pactados en convenios colectivos de trabajo (“CCT”) comprende el salario básico y las sumas remunerativas mensuales, normales y habituales (excluyendo premios y bonos, horas extras, sueldo anual complementario, etc.).


Asimismo, aclara que los aportes y contribuciones que los empleadores se comprometan a efectuar en el marco de los CCT, destinados a obras de carácter social, asistencial, previsional o cultural en interés y beneficio de los trabajadores, no se encuentran comprendidos en el límite del 2%.

The Executive Branch regulates the calculation base for collective bargaining contributions

Decree No. 612/2026, published and effective July 20, 2026, complements Decree No. 407/2026 by establishing that the calculation base for the contributions and assessments agreed upon in collective bargaining agreements (“CBAs”) includes the basic salary and normal, habitual, monthly remunerative sums (excluding bonuses and premiums, overtime, the annual complementary salary, etc.).


It also clarifies that the contributions and assessments that employers commit to making within the framework of CBAs for social, welfare, pension, or cultural purposes, in the interest and benefit of the workers, are not subject to the 2% limit.

La Secretaría de Energía unifica el régimen de exportación de hidrocarburos líquidos y sus derivados

Mediante la Resolución N° 166/2026 (la “Resolución”), dictada por la Secretaría de Energía, vigente desde el 22 de julio de 2026, se establecieron las normas y el procedimiento unificado para las exportaciones de hidrocarburos líquidos y sus derivados.


La Resolución deroga las Resoluciones N° 303/94, 241/2017 y 175/2023, y deja sin efecto el artículo 1 del Decreto N° 645/2002. Así, se elimina el requisito de la oferta previa obligatoria y se avanza hacia un esquema de notificación de exportación, con un plazo para que la Secretaría formule objeciones fundadas en motivos técnicos o económicos vinculadas a la seguridad de suministro; vencido ese plazo, la exportación queda habilitada. No obstante, dispone que las exportaciones autorizadas y/o solicitadas al amparo de las Resoluciones N° 241/2017 del entonces Ministerio de Energía y Minería y N° 175/23 del Ministerio de Economía, con anterioridad a la entrada en vigencia de la Resolución, continuarán rigiéndose por los términos y condiciones vigentes al momento de su autorización y/o presentación.

Entre las principales modificaciones introducidas por la presente Resolución, cabe destacar las siguientes:

  • Creación del Registro de Operaciones de Exportación: Se crea este registro en el cual deberán registrarse todas las Notificaciones de Exportación, las Objeciones de la autoridad y las Constancias de Libre Exportación que sean sustanciadas o emitidas en el marco del Decreto N° 1057/2024.
  • Productos alcanzados: Los productos alcanzados por la presente medida incluyen aceites crudos de petróleo, aceites crudos de mineral bituminoso, gasolinas (excepto de aviación), gasóleo (gasoil), propano crudo y los demás, butano y Gas Licuado de Petróleo (mezcla). La Secretaría de Energía podrá ajustar ese listado según las condiciones de abastecimiento del mercado nacional.
  • Notificación de exportación: Las personas físicas o jurídicas interesadas en exportar los productos alcanzados, deberán realizar su notificación presentando la información requerida a través de la plataforma Trámites a Distancia (TAD). La información proporcionada revestirá carácter de Declaración Jurada.
  • Exportaciones de Largo Plazo: Aquellas exportaciones que excedan un período de 12 meses consecutivos serán encuadradas como Exportaciones de Largo Plazo. Para estas, será obligatorio presentar contratos, acuerdos comerciales y la acreditación de disponibilidad proyectada de producción propia o reservas probadas, posibles y/o probables. Si la exportación supera los 60 meses consecutivos, el exportador deberá acreditar cada 3 años el derecho a disponer de los volúmenes comprometidos.
  • Capacidad de Transporte e Infraestructura: El interesado deberá informar bajo Declaración Jurada que tiene asegurada la capacidad de transporte por los volúmenes a exportar. Si la operación requiere ejecutar nuevos proyectos de infraestructura, se deberá acreditar su consistencia técnica y esquema de financiamiento, a menos que el exportador presente una constancia de inicio de trámite de adhesión al Régimen de Incentivo para Grandes Inversiones (RIGI).
  • Plazos y causales de objeción: La Autoridad de Aplicación podrá objetar parcial o totalmente una exportación sólo por razones técnicas o económicas fundadas, entre ellas: falta de abastecimiento interno (volumen y precio), falta de acreditación de reservas, falta de capacidad de transporte, prácticas anticompetitivas (dumping), o variaciones imprevistas en los precios del mercado interno. Los plazos máximos de objeción se fijan en 30 días hábiles administrativos para los aceites crudos, gasolinas y gasoil, y en 7 días hábiles administrativos para el propano, butano y GLP.
  • Subsanación de exportaciones objetadas: Si la exportación es objetada, el titular dispondrá de 5 días hábiles para presentar un descargo o proponer alternativas de subsanación. Dichas alternativas pueden incluir la renuncia total o parcial al volumen objetado, o bien el reemplazo a su costo del volumen mediante la adquisición y/o importación de hidrocarburos de calidad equivalente.
  • Constancia de Libre Exportación y Silencio Positivo: Vencidos los plazos previstos sin que existan objeciones, o en caso de haberse subsanado las mismas, la Autoridad emitirá la “Constancia de Libre Exportación”, que será exigida por la Dirección General de Aduanas para efectuar el despacho. Dicha constancia otorga estabilidad a los términos de la exportación notificada. Destacablemente, si la Autoridad omite expedirse transcurrido el plazo, el silencio de la administración tendrá sentido positivo, pudiendo el exportador exigir la emisión inmediata de su constancia.
  • Revocación y Cesión: La Constancia de Libre Exportación podrá revocarse ante el incumplimiento material y significativo de sus condiciones, de las obligaciones de información del titular, o si hay inexactitud grave en los datos informados. Por otro lado, la normativa habilita expresamente la posibilidad de ceder total o parcialmente la autorización otorgada a un tercero, sujeto a la conformidad previa de la Autoridad de Aplicación.

The Federal Department of Energy unifies the framework established for the export of liquid hydrocarbons and derivatives

By means of Resolution No. 166/2026 (the “Resolution”), issued by the Federal Department of Energy, and effective as of July 22, 2026, a unified regulatory framework and procedure have been established for the export of liquid hydrocarbons and their derivatives.


The Resolution repeals Resolutions Nos. 303/94, 241/2017 and 175/2023, and repeals Section 1 of Decree No. 645/2002. It eliminates the mandatory prior domestic offering requirement and replaces it with an export notification system, under which the Federal Department of Energy may raise objections on duly substantiated technical or economic grounds relating to the security of domestic supply. If no such objection is raised within the applicable timeframe, the export may proceed. Notwithstanding the foregoing, exports authorized and/or applied for under Resolution No. 241/2017 of the former Ministry of Energy and Mining and Resolution No. 175/23 of the Ministry of Economy prior to the entry into force of the Resolution shall continue to be governed by the terms and conditions in effect at the time the relevant authorization was granted or the application was submitted.

The main changes introduced by the Resolution include the following:

  • Creation of the Export Operations Registry: An Export Operations Registry is created in which all Export Notifications, objections issued by the competent authority, and Free Export Certificates processed or issued under Decree No. 1057/2024 must be recorded.
  • Covered Products: The registration requirement applies to products classified under specific tariff headings, including crude petroleum oils, crude oils obtained from bituminous minerals, motor gasoline (excluding aviation gasoline), gas oil (diesel), crude propane and other propane products, butane, and Liquefied Petroleum Gas (LPG) mixtures. The Federal Department of Energy may expand, amend, or exclude products from this list depending on domestic market supply conditions.
  • Export Notification: Individuals and legal entities intending to export covered products must submit an Export Notification through the Remote Procedures (Trámites a Distancia – TAD) platform, providing the required information. The information submitted shall constitute a sworn statement.
  • Long-Term Exports: Exports extending beyond 12 consecutive months shall be classified as Long-Term Exports. In such cases, exporters must submit the relevant contracts and commercial agreements, together with evidence demonstrating projected availability of their own production or proven, probable and/or possible reserves. Where the export term exceeds 60 consecutive months, exporters must demonstrate their continuing right to dispose of the committed export volumes every 3 years.
  • Transportation Capacity and Infrastructure: Exporters must certify, by means of a sworn statement, that they have secured sufficient transportation capacity for the export volumes involved. Where the export operation requires the development of new infrastructure projects, the exporter must demonstrate their technical feasibility and financing structure, unless it provides evidence that it has initiated the application process to adhere to the Incentive Regime for Large Investments (RIGI).
  • Objection Periods and Grounds for Objection: The Enforcement Authority may object, in whole or in part, to a proposed export only on duly substantiated technical or economic grounds. Such grounds include insufficient domestic supply (in terms of volume or price), failure to demonstrate reserves, insufficient transportation capacity, anti-competitive practices (including dumping), or unforeseen fluctuations in domestic market prices. The maximum objection period is 30 administrative business days for crude oils, gasoline and diesel fuel, and 7 administrative business days for propane, butane and LPG.
  • Remedy of Objected Exports: Where an export is objected to, the exporter shall have 5 business days to submit its response or propose corrective measures. Such measures may include a full or partial waiver of the objected export volume or the replacement, at the exporter's expense, of the affected volume through the purchase and/or import of hydrocarbons of equivalent quality.
  • Free Export Certificate and Positive Administrative Silence: If the applicable objection period expires without any objection, or once any objections have been satisfactorily remedied, the Enforcement Authority shall issue a Free Export Certificate, which must be presented to the National Customs Authority in order to complete customs clearance. The certificate provides regulatory stability with respect to the notified export conditions. Importantly, if the Authority fails to issue a decision within the applicable timeframe, administrative silence shall be deemed approval, entitling the exporter to demand the immediate issuance of the corresponding certificate.
  • Revocation and Assignment: The Free Export Certificate may be revoked in the event of a material and significant breach of its conditions, failure to comply with the holder's reporting obligations, or material inaccuracies in the information provided. In addition, the Resolution expressly authorizes the total or partial assignment of the export authorization to a third party, subject to the prior approval of the Enforcement Authority.

El Poder Ejecutivo convoca a Concurso Público Internacional para la exploración de hidrocarburos costa afuera en el área CAN_200

El 15 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia el Decreto N° 590/2026 (el “Decreto”), mediante el cual el Poder Ejecutivo Nacional instruyó a la Secretaría de Energía a convocar a un Concurso Público Internacional para el otorgamiento de un permiso de exploración de hidrocarburos en el área CAN_200, ubicada en la Cuenca Argentina Norte, ámbito costa afuera nacional, con una superficie aproximada de 5.000 km² en aguas profundas.


Conforme al Anexo I del Decreto, el permiso de exploración contempla un primer y un segundo período de exploración de cuatro años cada uno, con posibilidad de prórroga por cinco años adicionales, y un mínimo de 120 Unidades de Trabajo, y podrá incluir una cláusula de arbitraje internacional para la resolución de controversias.

La Secretaría de Energía deberá aprobar el Pliego de Bases y Condiciones que regirán el Concurso, y queda facultada, en su carácter de Autoridad de Aplicación de la Ley N° 17.319, para otorgar el permiso de exploración y, eventualmente, la concesión de explotación. Asimismo, el Decreto establece que el o los concesionarios que obtengan la concesión de explotación abonarán regalías sobre la producción, correspondiendo a la Secretaría de Energía dictar las normas complementarias relativas al procedimiento y la fórmula de cálculo respectiva, e incluir dichas previsiones en el Pliego de Bases y Condiciones.


El Poder Ejecutivo establece el mecanismo de fijación del precio unificado para el Gasoducto Perito Moreno

El 8 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia el Decreto de Necesidad y Urgencia N° 580/2026 (el “Decreto”), mediante el cual el Poder Ejecutivo Nacional reglamentó el mecanismo de fijación del precio unificado de la capacidad de transporte del Gasoducto Perito Francisco Pascasio Moreno (“GPM”), en el marco de la Reconfiguración del Sistema de Transporte de Gas Natural dispuesta por la Resolución N° 66/2026 de la Secretaría de Energía.

El Decreto derogó el Decreto N° 689/2002, que había exceptuado de la pesificación general a las tarifas y contratos de transporte de gas natural para exportación pactados en moneda extranjera, por entender que ese tratamiento excepcional ya no tenía justificación en el marco regulatorio vigente y generaba distorsiones respecto de la remuneración del resto de la infraestructura de transporte. Asimismo, fija un precio unificado para la capacidad de transporte del GPM, cuya capacidad, en la parte destinada a exportación, venía remunerándose bajo esquemas dispares.

El Decreto establece que el Ente Nacional Regulador del Gas y la Electricidad (“ENRGE”) deberá fijar el precio de la capacidad base en el GPM conforme al precio unificado previsto en la Iniciativa Privada de Transportadora de Gas del Sur S.A. para la licitación de la ampliación del Tramo I del gasoducto, declarada de interés público por el Decreto N° 1060/2024.

El ENRGE podrá disponer un escalonamiento entre los valores vigentes y el nuevo precio para evitar variaciones significativas.

The Executive Branch instructs the launch of an International Public Tender for offshore hydrocarbon exploration in area CAN_200

By means of Decree No. 590/2026 (the “Decree”),  published and effective  July 15, 2026, the National Executive Branch instructed the Federal Department of Energy to launch an International Public Tender for the granting of a hydrocarbon exploration permit in area CAN_200, located in the Cuenca Argentina Norte, within the national offshore area, covering an approximate surface of 5,000 km² in deep waters.


Under Annex I to the Decree, the exploration permit provides for a first and a second exploration period of four years each, with the possibility of a five-year extension, and a minimum of 120 Work Units, and may include an international arbitration clause for dispute resolution.

The Federal Department of Energy must approve the Terms and Conditions governing the Tender and the granting of the permit and concession, in its capacity as the Granting Authority under Law No. 17,319. The Decree further provides that the concessionaire(s) awarded the exploitation concession shall pay royalties on production, with the Federal Department of Energy responsible for issuing the supplementary rules regarding the applicable procedure and calculation formula, and for including such provisions in the Terms and Conditions.


The Executive Branch establishes the unified pricing mechanism for the Perito Moreno Natural Gas Pipeline

By means of Emergency Decree No. 580/2026 of July 8, 2026 (the “Decree”), the National Executive Branch set forth the unified price for the transportation capacity in the Perito Francisco Pascasio Moreno Pipeline (“GPM”), within the framework of the Reconfiguration of the Natural Gas Transportation System established under Resolution No. 66/2026 of the Federal Department of Energy.

The Decree repealed Decree No. 689/2002, which had exempted natural gas export tariffs and transportation contracts originally agreed in foreign currency from the mandatory conversion regime. The Executive Branch found that such exceptional treatment was no longer justified under the current regulatory framework and was generating distortions in the remuneration of the remaining transportation infrastructure. Furthermore, it  establishes a unified pricing mechanism for the transportation capacity of the GPM, whose export-bound capacity had been remunerated under disparate schemes.

The Decree provides that the National Regulatory Entity for Gas and Electricity (“ENRGE”) must set the base capacity price at the GPM by reference to the price awarded in the tender for the expansion of Section I of the pipeline in the context of the private initiative submitted by Transportadora de Gas del Sur S.A., declared to be of national public interest under Decree No. 1060/2024, in accordance with the unified pricing formula set forth therein.

ENRGE may implement a phase-in schedule between current values and the new unified price in order to avoid significant fluctuations.
