El Congreso Nacional promulga la Ley N° 21.828 que exige un Informe Anual de Equidad de Género a las empresas

El 23 de julio de 2026 se publicó la Ley N° 21.828 que promueve la transparencia y la adopción de medidas para fomentar la inclusión laboral de las mujeres.


La norma establece la obligación de elaborar un informe anual a las empresas: (a) con 200 o más trabajadores; o (b) con 50 o más trabajadores que pertenezcan a los sectores minero, de investigación y desarrollo, financiero, de energía, del transporte y de la construcción.

El informe debe contemplar, al menos, el porcentaje de participación de mujeres dentro de la organización, indicadores sobre su ejercicio en cargos de responsabilidad, medidas para la conciliación de la vida laboral, familiar y personal, antecedentes sobre brechas salariales y otras medidas adoptadas para promover la equidad de género.

El Ministerio del Trabajo fijará los parámetros para elaborar el informe, el cual deberá ser remitido en el mes de marzo de cada año a la Dirección del Trabajo y mantenerse a disposición del público en el sitio web oficial de la empresa.

The National Congress enacts Law No. 21,828 requiring companies to prepare an Annual Gender Equity Report

On July 23, 2026, Law No. 21,828 was published. The law promotes transparency and the adoption of measures to foster the inclusion of women in the workforce.


The law requires the following companies to prepare an annual report: (a) with 200 or more employees; or (b) with 50 or more employees operating in the mining, research and development, financial services, energy, transportation, or construction sectors.

The report must include, at a minimum, the percentage of women within the organization, indicators regarding their representation in leadership and management positions, measures to balance work, family, and personal life, information on the gender pay gap, and other measures adopted to promote gender equity.

The Ministry of Labor will establish the parameters for preparing the report, which must be submitted to the Chilean Labor Directorate each March and remain publicly available on the company's official website.
