Labor Law

Labor Assistance Fund’s entry into force is postponed to December 1, 2026 and the waiting period is extended to 12 months

On October 20, 2026, Decree No. 1228/2026 (the “Decree”) was published in the Official Gazette. It amends Decree No. 408/2026, which regulates the Labor Assistance Fund (“FAL”) created by the Labor Modernization Law No. 27,802 (the “Law”).

The Decree entered into force on the same day of its publication. Its main aspects are highlighted below:

  • New date of entry into force: The FAL regime, which the Law had scheduled for June 1, 2026 and which Decree No. 408/2026 had postponed to November 1, 2026, will enter into force on December 1, 2026.
  • 12-month waiting period: The FAL will not be able to cover the obligations arising from the termination of the employment relationship until a waiting period has elapsed, intended to allow the funds to accumulate the necessary resources. The Law sets a minimum of 6 monthly periods and the Decree increases it to 12.
  • Employer contributions: Until the FAL enters into force, employers must pay employer contributions without the reduction provided for in the Law, equivalent to the FAL contribution (1% for large companies and 2.5% for Micro, Small and Medium-sized Companies).
