The National Executive Branch regulates the Cold Zone Regime and approves the trust agreement template for gas subsidies

On October 26, 2026, Decree No. 1266/2026 (the “Decree”) entered into force, regulating Chapter I of Law No. 27,828 concerning amendments to the Cold Zone Regime and approving the model trust agreement for the Trust Fund for Gas Consumption Subsidies (the “Trust Fund”).

The Decree establishes the procedures for collecting and remitting the surcharges allocated to the Trust Fund, as well as for determining and paying compensation under the regime. In particular, it provides for the financing of discounts applicable to gas consumption covered by the Cold Zone Regime and benefits available to certain residential users, subject to the conditions set forth in Law No. 27,828.

With respect to surcharges, the regulations identify natural gas producers and importers as collection agents, subject to the applicable exceptions for exports of natural gas or liquefied natural gas (“LNG”) and imports of regasified LNG. The surcharge must be itemized separately on invoices and does not form part of the sale price of natural gas. Collection agents must remit the amounts collected and file monthly sworn statements with the Tax and Customs Collection and Control Agency (ARCA), in accordance with the prescribed procedures.

The Decree also designates the Federal Department of Energy as the enforcement authority of the Cold Zone Regime, empowering it to determine the applicable compensation and/or discounts and to issue supplementary or clarifying regulations. The regulations further provide for the involvement of the National Gas and Electricity Regulatory Entity (ENReGE) in reviewing information submitted by distributors and subdistributors to determine compensation. These entities must continue applying discounts to end users’ bills and act as information agents, but will no longer receive or manage the funds: compensation will be paid directly to gas supplier companies.

In addition, the Decree approves a new model trust agreement between the National State, as settlor, and Banco de la Nación Argentina, as trustee. The agreement replaces the existing instrument to reflect the amendments introduced by Law No. 27,828, without creating a new trust fund or extinguishing or liquidating the existing one. The Trust Fund’s legal, financial and operational continuity is preserved, together with its assets, rights, credits and obligations. The replacement does not constitute a novation or affect pre-existing rights and obligations. The Decree also repeals Decree No. 486/2021 and keeps Decree No. 786/2002 in force to the extent not inconsistent with Law No. 27,828.

Finally, the Decree invites companies supplying natural gas, undiluted propane gas through distribution networks, and liquefied petroleum gas to adhere to the trust agreement as a condition for accessing compensation under the regime, which adherence must take place before marketing gas under the regime. It also invites the provinces to adhere to the Cold Zone Regime. The Trust Fund will remain in force until December 31, 2031, with an additional period as necessary to complete the liquidation of operations, obligations and claims accrued during its term.

The Federal Department of Energy amends the Wholesale Electricity Market normalization rules and accelerates term contracting

On October 21, 2026, Resolution No. 293/2026 of the Federal Department of Energy (the “Resolution” and the “SE”, respectively) was published in the Official Gazette and became effective. The Resolution amends the “Rules for the Normalization of the WEM and its Progressive Adaptation” (the “Rules”), approved by SE Resolution No. 400/2025. It focuses on three areas: generators’ cost declarations, the entry of large users into the Wholesale Electricity Market (“WEM”), and contracting in the Term Market.

First, the Resolution amends the ranges within which generators that manage their own fuel may declare their Variable Production Cost. The margin for declaring below the reference value is expanded, while the margin allowed above it is gradually reduced. During 2026, the range remains between 75% and 125% of the reference value. In 2027 it will be 50% to 117.5%, and from 2028 onwards, 25% to 110%. The additional margin for GN Acuerdo remains at 0%, and the optional regime for liquid fuels is not amended.

Second, the Resolution approves a simplified procedure allowing Major Large Users (“GUMA”) and Minor Large Users (“GUME”) to join the WEM on a monthly basis, replacing the quarterly windows. The most relevant change is the elimination of tacit approval: entry will require an express resolution by the SE, following publication of the application in the Official Gazette, during which WEM agents may file well-founded objections. An objection suspends the challenged application and must be resolved by the National Gas and Electricity Regulatory Entity within 20 calendar days. If the entity fails to rule within that period, the objection will be deemed valid. The procedure will apply from December 1, 2026, so the first entries under this regime may take effect as from February 1, 2027.

Finally, the Resolution accelerates the expansion of bilateral contracting. The cap on the monthly output that may be contracted with WEM Large Users (GUMA, GUME and Particular Large Users, GUPA) applies to Spot thermal generation and Spot hydroelectric generation not included in the Allocated Generation, in both cases acceding the WEM before January 1, 2025. The cap remains at 20% until March 31, 2027, and rises to 60% from April 1, 2027, and to 80% from April 1, 2028. As from January 1, 2029, one year earlier than originally scheduled, such generation may contract with any type of Spot Demand without percentage caps. For thermal generation, these caps also cover contracts with distributors for their Distributor Large Users (“GUDI”). Hydroelectric generation, by contrast, may contract with distributors for their GUDI without a percentage cap. Both may continue to contract their entire output with distributors to supply the Uncovered Seasonal Demand.

ENReGE launches public consultation on updated Natural Gas Storage Regulations, incorporating offshore LNG facilities

On October 15, 2026, Resolution No. 767/2026 of the National Gas and Electricity Regulatory Entity (the “Resolution” and “ENReGE”, respectively) was published in the Official Gazette. The Resolution submits to public consultation a draft update of the “Regulations for Natural Gas Storage” (the “Regulations”).

To date, natural gas storage has been governed by two parallel regimes: the Regulations, which apply to onshore facilities, and the special regime under Federal Department of Energy (“SE”) Resolution No. 338/2012 for offshore Liquefied Natural Gas (“LNG”) facilities. The draft seeks to merge both into a single registration and technical safety framework, regardless of where the facilities are located. In this regard, the SE stated that it will promote the repeal of SE Resolution No. 338/2012.

Accordingly, the Regulations will now expressly cover “fixed or mobile offshore storage”, while excluding onboard storage facilities associated with vessel propulsion and “bunkering”. For floating facilities, the draft adopts a framework based on international certifications. The storage operator must evidence, under sworn statement, valid certifications issued by Classification Societies that are members of the International Association of Classification Societies Ltd., in accordance with the instruments of the International Maritime Organization, together with documentation from the Argentine Naval Prefecture, where applicable. In addition, each terminal must have a Quantitative Risk Analysis that assesses it as an integrated system and is updated at least every five years. Specific insurance coverage is also required for terminals in jurisdictional waters and their floating units.

Furthermore, LNG carriers temporarily entering Argentine jurisdictional waters exclusively for foreign trade operations will not be required to register with the Natural Gas Storage Registry of the Argentine Republic (“RAGNar”). This exemption does not extend to units regularly engaged in LNG operations within the national territory.

In addition, parties that are operating or have built storage facilities when the Regulations enter into force must declare them with the RAGNar within 20 administrative business days. Otherwise, those facilities will be automatically disqualified. Notably, under SE Resolution No. 145/2025, RAGNar registration is a prerequisite for obtaining LNG export authorizations.

Interested parties may submit comments within 30 administrative business days from the publication of the Resolution, through ENReGE’s Virtual Filing Desk. Such comments will not be binding.
