El viernes 28 de junio se concluyeron en Bruselas las negociaciones para la posterior firma de un Acuerdo de Asociación Estratégica entre el Mercado Común del Sur (Mercosur) y la Unión Europea (UE) (el Acuerdo), culminando de esta forma esta etapa de la negociación que se extendió por más de 20 años.

El Acuerdo creará un mercado de bienes y servicios de 800 millones de consumidores y casi una cuarte parte del PBI mundial.

Es importante destacar que el Acuerdo no implica una apertura inmediata para las importaciones al Mercosur ya que, por una concesión de la UE, se aplicará un sistema de desgravación gradual para los productos originarios de la UE, que prevé plazos de  hasta 15 años para la entrada en vigencia de las mejores arancelarias.

En contraposición la desgravación arancelaria de las exportaciones de productos del Mercosur a la UE se realizará en plazos sustancialmente menores, y más del 85% de esas exportaciones gozarán de una eliminación de aranceles en la UE de forma inmediata.

En relación a los bienes industriales, la UE liberaliza cerca del 100% de su comercio. El Mercosur lo hace en un 90%.

La UE ofrece la liberalización completa e inmediata de aranceles para el 80% de las exportaciones del Mercosur de productos industriales a la UE; mientras que el Mercosur obtiene plazos amplios de hasta 15 años para liberalizar sectores sensibles en forma gradual.

En relación a bienes agroindustriales (cuyas exportaciones argentinas a la UE son del 63%), la UE liberaliza el 99% de las importaciones del Mercosur. Para el 81,87% eliminará los aranceles de importación. En tanto para el 17,7% restante ofrecerá cuotas o preferencias fijas.

El Acuerdo establecerá mecanismos de salvaguardias bilaterales que permitirán suspender temporalmente las preferencias arancelarias o reducirlas en caso de amenaza o daño grave a un sector industrial e implementará un mecanismo de solución de controversias.

Asimismo, eliminará barreras no arancelarias, facilitará las exportaciones y contendrá protocolos sanitarios, fitosanitarios, procedimientos de certificación en materia de origen y previsibilidad y transparencia regulatoria.

Con respecto a los servicios, los prestadores de la UE y del Mercosur podrán acceder al mercado de la contraparte en las mismas condiciones que los nacionales.

Para formalizar el Acuerdo, se deberá redactar y elevar el texto a la aprobación de los congresos de los países del Mercosur y al Parlamento europeo.

On June 28, 2019 the Southern Common Market (MERCOSUR) and the European Union (EU), concluded, after more than twenty years, negotiations in Brussels for the subsequent signing of a Trade Agreement (the Agreement).

The Agreement will create a market of goods and services of 800 million consumers and almost a quarter of the world´s GDP.

It is important to note that the Agreement does not entail an immediate opening of imports into Mercosur since, due to an EU concession, a system of gradual tariff reduction will be applied to EU products, which provides for terms of up to 15 years for the entry into force of the tariff improvements.

In contrast, tariff reductions of exports of Mercosur products to the EU will be made in substantially shorter terms, and more than 85% of those exports will enjoy immediate tariff elimination in the EU.

In terms of industrial goods, the EU will liberalize almost 100% of its trade. Mercosur will do so by 90%.

The EU will offer full and immediate liberalization of tariffs for 80% of Mercosur´s exports of industrial products to the EU; while Mercosur will obtain long terms of up to 15 years to gradually liberalize certain sensitive sectors.

Considering agro-industrial goods (Argentina´s exports of these goods to the EU reach up to 63%), the EU will liberalize 99% of Mercosur's imports. For 81.87% of these goods, the EU will eliminate import tariffs. For the remaining 17.7%, it will offer quotas or fixed preferences.

The Agreement will establish bilateral safeguard mechanisms that will allow temporary suspension of tariff preferences or their reduction in case of threat or serious damage to an industrial sector, and will implement a dispute resolution mechanism.

Additionally, it will eliminate non-tariff barriers, facilitate exports, and will include sanitary and phytosanitary protocols, and certification procedures for origin, predictability and regulatory transparency.

With regard to services, EU and Mercosur will offer the other party´s services providers the same treatment it gives to its own national providers.
 
In order to formalize the Agreement, the text will have to be drafted and raised to the Congresses of each of Mercosur's Parties and the European Parliament for its approval.
