Conservation of Natural Resources and Real Estate

Modificaciones a la Ley Nº 26.815 de Manejo del Fuego

El 24 de diciembre de 2020, a través de la publicación en el Boletín Oficial del Decreto Nº 1038/2020, se promulgó la Ley Nº 27.604 que introduce modificaciones a la Ley Nº 26.815 de Manejo del Fuego (la “Ley”).

La Ley, a partir de las modificaciones introducidas, establece que:

i. Ante incendios, provocados o accidentales, que quemen vegetación viva o muerta, en bosques nativos o implantados, así como en áreas naturales protegidas debidamente reconocidas y humedales, se prohíbe por el término de 60 años desde su extinción: a) Realizar modificaciones en el uso y destino que dichas superficies poseían con anterioridad al incendio; b) La división o subdivisión, excepto que resulte de una partición hereditaria; el loteo, fraccionamiento o parcelamiento, sea parcial o total, o cualquier emprendimiento inmobiliario, distinto al arrendamiento y venta, de tierras particulares; c) La venta, concesión, división, subdivisión, loteo, fraccionamiento o parcelamiento, total o parcial, o cualquier otro emprendimiento inmobiliario, distinto al arrendamiento, de tierras fiscales; y d) Cualquier actividad agropecuaria que sea distinta al uso y destino que la superficie tuviera al momento del incendio.

ii. Ante incendios, provocados o accidentales, que quemen vegetación viva o muerta, en zonas agropecuarias, praderas, pastizales, matorrales y en áreas donde las estructuras edilicias se entremezclan con la vegetación fuera del ambiente estrictamente urbano o estructural, se prohíbe por el término de 30 años desde su extinción: a) La realización de emprendimientos inmobiliarios; b) Cualquier actividad agropecuaria que sea distinta al uso y destino que la superficie tuviera previo al momento del incendio; y c) La modificación de uso de una superficie con el fin de desarrollar prácticas agropecuarias intensivas, excepto en los casos que dichas prácticas y modalidades hubiesen antecedido al evento.

Amendments to Law No. 26,815 on Fire Management

On December 24, 2020, Law No. 27,604, introducing amendments to Law No. 26,815 on Fire Management (the “Law”), was enacted.

Now the Law states that:

i. In case of fires, provoked or accidental, that burn live or dead vegetation, in native or implanted forests, as well as in duly recognized protected natural areas and wetlands, it is prohibited for a term of 60 years from their extinction: a) Make modifications in use and destination that said surfaces had prior to the fire; b) The division or subdivision, except that it results from a hereditary partition; the subdivision, subdivision or subdivision, whether partial or total, or any real estate undertaking, other than the leasing and sale, of private lands; c) The sale, concession, division, or subdivision, total or partial, or any other real estate undertaking, other than leasing, of public lands; and d) Any agricultural activity that is different from the use and destination that the surface had at the time of the fire.

ii. In case of fires, provoked or accidental, that burn living or dead vegetation, in agricultural areas, meadows, pastures, bushes and in areas where the building structures intermingle with the vegetation outside the strictly urban or structural environment, it is prohibited for a term of 30 years from their extinction: a) Carrying out real estate projects; b) Any agricultural activity that is different from the use and destination that the surface had prior to the time of the fire; and c) The modification of the use of a surface in order to develop intensive agricultural practices, except in cases where such practices and modalities had preceded the event.
