Decreto de Necesidad y Urgencia 665/2019. Asignación a trabajadores del sector privado

El 26 de septiembre de 2019 se publicó en el Boletín Oficial el DNU 665/2019, que con el declarado propósito de “mantener los estándares adquisitivos de las remuneraciones”, estableció una asignación no remunerativa –no sujeta a aportes y contribuciones con destino a la seguridad social- para todos los trabajadores en relación de dependencia del sector privado de $5.000.

Se encuentran excluidos los trabajadores del sector público nacional, provincial y municipal, del mismo modo que los alcanzados por el régimen agrario y de casas particulares.

Dicha asignación no remunerativa deberá abonarse en el mes de octubre de 2019, o en los plazos, cuotas y condiciones que establezcan las partes signatarias de convenios colectivos.

Cuando la prestación de servicios fuere inferior a la jornada legal o convencional, los trabajadores percibirán dicha asignación en forma proporcional.

Dispone también que la asignación no remunerativa se compensará en las próximas revisiones salariales y que los empleadores que hubiesen otorgado, unilateralmente o por acuerdo de manera extraordinaria, otros incrementos sobre los ingresos de los trabajadores a partir del 12 de agosto de 2019, podrán compensarlos hasta su concurrencia.

Emergency Decree 665/2019. Non-remunerative payment to private sector employees

On September 26, 2019, Emergency Decree 665/2019 was published in the Official Gazette, which, with the purpose of “maintaining the purchasing power of salaries”, established a non-remunerative payment - not subject to contributions to the social security system- for all the private sector employees equivalent to AR$ $5,000.

Employees of national, provincial and municipal public sector are excluded as well as those under the scope of the agrarian and private homes regimes.

Said non-remunerative payment must be made in October 2019, or according to the terms, installments and conditions set forth by the signatory parties to collective bargaining agreements.

When the services are rendered for less than the legal or conventional working day, employees will receive of such non-remunerative payment proportionally.

The Emergency Decree also provides that the non-remunerative payment will be offset in the next salary revisions and that employers who have granted, unilaterally or by extraordinary agreement, other increases as of August 12, 2019, may offset them up to the amount of the non-remunerative payment.
