La ANAC reglamenta la garantía de servicios mínimos de navegación aérea durante medidas de acción directa

El 26 de marzo de 2026 se publicó en el Boletín Oficial la Resolución N° 173/2026, mediante la cual la Administración Nacional de Aviación Civil (“ANAC”) reglamentó la prestación de los servicios aeronáuticos durante el ejercicio de medidas de acción directa.

Esta medida surge como respuesta a las reformas introducidas por la Ley N° 27.802, que redefinió el régimen de servicios esenciales e incorporó parámetros objetivos para garantizar la continuidad, seguridad y regularidad del transporte aéreo en el territorio argentino.

Las disposiciones más relevantes se detallan a continuación:

  • Porcentaje mínimo de prestación: Se ratifica que, durante huelgas o medidas gremiales, se debe garantizar un mínimo del 75% de la prestación del servicio.
  • Alcance de la garantía: El cálculo de la prestación mínima se aplicará sobre la franja horaria afectada, incluyendo operaciones regulares y no regulares desde, hacia o dentro de la República Argentina.
  • Exclusiones críticas: En ningún caso las medidas de fuerza podrán afectar a aeronaves públicas o sanitarias, aeronaves en vuelo o que iniciaron operaciones antes de la medida, y destinos con una única frecuencia diaria de transporte.
  • Gestión de planes de vuelo: Los prestadores deben gestionar todos los planes de vuelo presentados con anterioridad al inicio del conflicto.
  • Suspensión por meteorología: Las medidas gremiales deberán suspenderse obligatoriamente si el pronóstico indica condiciones meteorológicas adversas (niebla, tormentas, etc.) que alteren el desarrollo normal de los vuelos.
  • Plazo de normalización: Una vez concluida la franja de afectación, el tránsito aéreo deberá normalizarse en un plazo máximo de 30 minutos.
Esta reglamentación busca equilibrar el derecho constitucional de huelga con el carácter estratégico del transporte aéreo, asegurando la conectividad y el resguardo del interés público.

ANAC regulates the guarantee of minimum air navigation services during direct action measures

On March 26, 2026, Resolution No. 173/2026 was published in the Official Gazette, by means of which the National Civil Aviation Administration ("ANAC") provided the regulation of aeronautical services during strikes and other potential labor actions.

This measure arises in response to the reforms introduced by Law No. 27.802, which redefined the essential services regime and incorporated objective parameters to guarantee the continuity, safety, and regularity of air transport within Argentine territory.

The most relevant aspects of the regulation are detailed below:

  • Minimum service percentage: During labor actions, the minimum level of services that must be guaranteed is 75%, as per applicable law.
  • Calculation of provision: The guarantee for the legal minimum provision will be calculated based on the affected time slot of the schedule, including regular and non-regular operations within, from, or to Argentina.
  • Critical exclusions: Labor actions may not affect public or medical/sanitary aircraft, aircraft in flight or those that initiated operations prior to the start of the labor action, and commercial operations to or from destinations that have only a single daily transport frequency.
  • Flight plan management: Flight plans presented prior to the start of the affected time slot must be accepted and managed at all times.
  • Weather suspension: Labor measures must be suspended when forecasts indicate adverse weather conditions that alter normal flight development such as fog, mist, or thunderstorms.
  • Normalization period: Once the labor action concludes, air traffic must be normalized within 30 minutes.
This regulation seeks to balance the constitutional right to strike with the strategic nature of air transport, ensuring connectivity and the protection of the public interest.
