El INPI implementa un nuevo esquema arancelario indexado y modifica los procedimientos de registro de marcas y patentes

A partir del primer trimestre de 2026, el Instituto Nacional de la Propiedad Industrial (“INPI”) ha puesto en vigencia un paquete de resoluciones que transforman la operatividad del sistema de propiedad intelectual en Argentina.

Los puntos destacados de las reformas son:

  • Nuevo esquema de aranceles: Se abandonan los aranceles fijos en pesos. Se crea la Unidad de Medida Arancelaria de la Propiedad Industrial (“UMAPI”), cuyo valor se actualizará mensualmente según el Índice de Precios al Consumidor (IPC). A modo de referencia, una solicitud de marca nueva (en una clase y con hasta 20 productos/servicios) equivale a 100 UMAPIs y la renovación equivale 200 UMAPIs (es decir, $36.000 y $72.000 a valores actuales, respectivamente).
  • Procedimiento de marcas (Res. 583/2025 y 63/2026): Desde el 1 de marzo de 2026, rige un nuevo reglamento que acelera los tiempos de concesión:
    - Examen Anticipado: El INPI realizará el examen formal y de fondo antes de la publicación. Si no hay oposiciones tras 30 días de publicado, el registro se concederá automáticamente.
    - Limitación del Examen de Oficio: El INPI ya no bloqueará de oficio solicitudes por confundibilidad con marcas existentes (salvo casos de identidad total) ni por términos genéricos o engañosos. Esta modificación traslada la carga de defensa a los titulares, haciendo crítico el servicio de vigilancia marcaria para detectar solicitudes que afecten sus activos.
    - Digitalización y Plazos: Se eliminan los plazos de gracia y las notificaciones serán 100% electrónicas vía portal, iniciando el cómputo de plazos de respuesta de manera inmediata.
  • Patentes y Transferencia de Tecnología (Res. 38/2026): 
    - Se derogan restricciones históricas para el examen de patentes en la industria farmacéutica, agilizando el otorgamiento de títulos para medicamentos.
    - Se simplifica el registro de Contratos de Transferencia de Tecnología (Ley 22.426), limitando el control del INPI a la verificación del objeto del contrato y su efecto en el país.

INPI implements a new indexed fee schedule and modifies trademark and patent registration procedures

As of the first quarter of 2026, the National Institute of Industrial Property (“INPI”) has enacted a series of resolutions that transform the operation of the intellectual property system in Argentina.

The highlights of the reforms are as follows:

  • New Fee Schedule: Fixed fees in Pesos are abandoned. The Industrial Property Fee Measurement Unit (“UMAPI”) is created, whose value will be updated monthly according to the Consumer Price Index. For reference, a new trademark application (in one class and with up to 20 products/services) is equivalent to 100 UMAPIs, and a renewal is equivalent to 200 UMAPIs (i.e., $36,000 and $72,000 at current values, respectively).
  • Trademark Procedure (Res. 583/25 and 63/2026): Since March 1, 2026, a new regulation has been in effect that accelerates granting timelines:
    - Prior Examination: INPI will conduct the formal and substantive examination before publication. If no oppositions are filed within 30 days of publication, the registration will be granted automatically.
    - Limitation of Ex Officio Examination: The agency will no longer ex officio block applications due to likelihood of confusion with existing trademarks (except in cases of total identity) or for generic or misleading terms. This modification shifts the burden of defense to the owners, making trademark monitoring services critical to detect applications that may affect their assets.
    - Digitalization and Deadlines: Grace periods are eliminated, and notifications will be 100% electronic via the web portal, with the response periods beginning immediately upon notification.
  • Patents and Technology Transfer (Res. 38/2026):
    - Historical restrictions for patent examination in the pharmaceutical industry are repealed, streamlining the granting of titles for medicines.
    - The registration of Technology Transfer Agreements (Law No. 22,426) is simplified, limiting INPI's control to verifying the subject matter of the contract and its effect within the country.
