La DNDA aprueba el Reglamento del Procedimiento de Mediación Administrativa Voluntaria

Se formaliza un proceso administrativo gratuito ante la DNDA para que usuarios o cámaras sectoriales y sociedades de gestión colectiva resuelvan disputas por aranceles de derechos de autor, buscando agilizar acuerdos y evitar la judicialización de los reclamos.

El 24 de febrero de 2026 entró en vigencia la Disposición N° 2/2026 de la Dirección Nacional del Derecho de Autor (la “DNDA”) que aprobó el reglamento del “Procedimiento de Mediación Administrativa Voluntaria”, previsto en el Decreto N° 138/2025. Los aspectos más destacados del nuevo procedimiento son:

  • Objeto y Legitimación: El procedimiento está destinado a resolver controversias vinculadas con los aranceles por la utilización de obras protegidas. Pueden acceder usuarios individuales, cámaras o entidades representativas y sociedades de gestión colectiva debidamente registradas.
  • Inicio y Requisitos: El trámite se inicia a instancia de parte mediante un formulario que debe contener la identificación de las partes, el domicilio constituido en la Plataforma de Trámites a Distancia (TAD), una descripción sucinta de la controversia y la manifestación expresa de someterse al régimen.
  • Audiencias y Plazos: La primera audiencia será fijada por la DNDA de Mediación dentro de los 10 días hábiles de designado el mediador. El procedimiento no podrá exceder de 3 audiencias, salvo acuerdo en contrario.
  • Principios y el Mediador: El proceso se rige por la voluntariedad, gratuidad, imparcialidad, confidencialidad y celeridad. El mediador será un funcionario del Ministerio de Justicia con al menos 2 años de antigüedad en el Registro Nacional de Mediación.
  • Conclusión y Efectos: De arribarse a un acuerdo, este se instrumentará en un acta suscrita por las partes. El mediador expedirá un acta de cierre que consignará la existencia del acuerdo, el cual no tendrá carácter de título ejecutivo y tendrá efectos únicamente entre las partes intervinientes.
  • Relación con otras vías: El reglamento aclara que este mecanismo no sustituye la mediación prejudicial obligatoria (Ley N° 26.589) ni constituye un requisito previo para el acceso a la vía judicial.

DNDA approves the Voluntary Administrative Mediation Procedure Regulations

A free administrative process before the DNDA is formalized for users, sector chambers, and collective management organizations to resolve copyright tariff disputes, aiming to expedite agreements and prevent the judicialization of claims.

On February 24, 2026, Disposition No. 2/2026 of the National Copyright Agency (“DNDA”, after its Spanish acronym) came into effect, approving the regulations for the “Voluntary Administrative Mediation Procedure,” as provided for in Decree No. 138/2025. The most highlighted aspects of the new procedure are:

  • Subject Matter and Standing: The procedure is intended to resolve disputes related to tariffs for the use of protected works. Individual users, chambers or representative entities, and duly registered collective management organizations may access it.
  • Commencement and Requirements: The process begins at the request of a party through a form that must include the identification of the parties, the registered address on the Remote Procedures Platform (TAD), a brief description of the dispute, and an express statement to submit to the regime.
  • Hearings and Deadlines: The first hearing will be scheduled by the DNDA Mediation unit within 10 business days of the mediator's appointment. The procedure may not exceed 3 hearings, unless otherwise agreed.
  • Principles and the Mediator: The process is governed by the principles of voluntariness, gratuity, impartiality, confidentiality, and celerity. The mediator shall be an official from the Ministry of Justice with at least 2 years of seniority in the National Mediation Registry.
  • Conclusion and Effects: If an agreement is reached, it will be formalized in minutes signed by the parties. The mediator will issue a closing minute stating the existence of the agreement, which will not constitute an executive title and will only have effect between the participating parties.
  • Relationship with other avenues: The regulations clarify that this mechanism does not replace mandatory pre-judicial mediation (Law No. 26,589) nor does it constitute a prior requirement for access to judicial proceedings.
