Nuevas regulaciones en materia de Derecho Aeronáutico

Esta semana se publicaron en el Boletín Oficial las siguientes nuevas reglamentaciones relacionadas con la industria aeronáutica:

Procedimiento para la obtención de reconocimiento de Certificados de Explotadores de Servicios Aéreos: A través de la Resolución N° 259/2024 de la Administración Nacional de Aviación Civil (la “ANAC”) se aprueba la Parte 129 de las Regulaciones Argentinas de Aviación Civil (RAAC), regulación de las “Operaciones de Explotadores Extranjeros”. 

Se otorga un plazo de 60 días hábiles administrativos a los transportistas extranjeros -con operaciones transporte aéreo comercial internacional de pasajeros, carga y correo-, para iniciar el proceso de reconocimiento de sus certificados de explotadores de servicios aéreos (AOC, por su sigla en inglés) ante la ANAC.

Por su parte, la regulación establece el procedimiento a seguir para la tramitación y obtención del reconocimiento.

Reglamentación del otorgamiento de licencias aeronáuticas de certificación de idoneidad: A través del Decreto N° 752/2024, se instruye a la ANAC a reglamentar técnicamente el artículo 76 del Código Aeronáutico -sobre la certificación de idoneidad para las personas que realicen funciones aeronáuticas según parámetros allí indicados- dentro del plazo de 180 días a partir de su publicación.

Se establece que las licencias aeronáuticas se tramitarán y se expedirán en formato digital y cumplirán con los principios de seguridad operacional, pudiendo ser extendidas por autoridad delegada, auditada por la autoridad técnica aeronáutica.

Por otra parte, la Resolución Nº 263/2024 de la ANAC, aprueba el procedimiento para la retención de Certificados de Idoneidad Aeronáutica.

Exigencia de contar con Grabadores de Voz de Cabina: A través de la Resolución Nº 264/2024 de la ANAC se establece la obligación de contar con Grabadores de Voz de Cabina (CVR, por su sigla en inglés), que sea capaz de conservar la información grabada durante al menos las últimas 25 horas de su funcionamiento para aviones que tengan un peso máximo certificado de despegue de más de 27.000 kilogramos.

New regulations in Aviation Law

The following new regulations related to the aviation industry were published in the Official Gazette this week:

Procedure for the granting of the recognition required for Air Service Operator Certificates: Resolution No. 259/2024 of the National Civil Aviation Administration (“ANAC“, after its Spanish acronym) approves the Section 129 of the Argentine Civil Aviation Regulations (RAAC, after its Spanish acronym), regulation of “Operations of Foreign Operators”. 

A 60 working day term for international carriers -with operations of international commercial air transportation of passengers, cargo and correspondence- to initiate with the ANAC the process of recognition of their Air Operator Certificates (AOC) is established.

The regulation establishes the procedure that has to be followed to process and acquire such recognition.

Regulation for the granting of aeronautical licenses of competence certification: Pursuant to Decree No. 752/2024, the ANAC has been instructed to provide regulation for Section 76 of the Aeronautical Code -on the certification of competence for persons performing aeronautical functions according to the parameters indicated therein- within the next 180 days as from its publication.

It is established that aeronautical licenses shall be processed and issued in digital format and shall comply with the principles of operational safety; these may be issued by a delegated authority, audited by the aeronautical technical authority.

On the other hand, Resolution No. 263/2024 of ANAC approves the procedure for the retention of Certificates of Aeronautical Competence.

Requirement to have Cockpit Voice Recorders: Per Resolution No. 264/2024 of ANAC, the authority establishes the obligation to have Cockpit Voice Recorders (CVR), which must be capable of keeping the recorded information for at least the last 25 hours of its operation for aircraft with a maximum certified take-off weight of more than 27,000 kilograms.
