Se declara la Emergencia del Sector Energético Nacional por DNU
El 18 de diciembre de 2023 se publicó en el Boletín Oficial, y entró en vigencia, el Decreto de Necesidad y Urgencia N° 55/2023 (el “DNU”) por medio del cual el Presidente declaró la Emergencia del Sector Energético Nacional.
Los segmentos afectados son los de generación, transporte y distribución de energía eléctrica bajo jurisdicción federal y de transporte y distribución de gas natural. El plazo de vigencia para la declaración de emergencia, y las acciones que surjan de ella, es hasta el 31 de diciembre de 2024. Se instruye a la Secretaría de Energía la elaboración e implementación de un programa de acciones que permitan: mecanismos para la sanción de precios en competencia y libre acceso, mantener los niveles de ingresos, cubrir las necesidades de inversión y garantizar la prestación continua de los servicios públicos, en condiciones técnicas y económicas adecuadas, tanto para los prestadores como para los usuarios.
Se determina el inicio de la revisión tarifaria y el plazo límite del 31 de diciembre de 2024 para la entrada en vigencia de los nuevos cuadros tarifarios. En línea con esto, el 15 de diciembre de 2023 se había publicado la Resolución N° 704/2023 del Ente Nacional Regulador del Gas (ENARGAS), donde se convocó a Audiencia Pública N° 104. El objeto de la audiencia incluye poner a consideración la adecuación transitoria de las tarifas del servicio público de transporte de gas natural y de distribución de gas por redes, entre otras cuestiones.
Por otra parte, en el DNU se dispone la intervención del Ente Nacional Regulador de la Electricidad (ENRE) y del ENARGAS a partir del 1 de enero de 2024 y hasta la designación de los miembros del Directorio que resulten de los procesos de selección correspondientes (artículo 8 del DNU).
Se faculta a la Secretaría de Energía a designar interventores del ENRE y ENARGAS, que deberán:
- Informar sobre el cumplimiento de los procesos de renegociación.
- Realizar los procesos de revisión tarifaria, pudiendo en el intermedio establecer ajustes periódicos y adecuaciones transitorias de tarifas.
- Evaluar e informar sobre la gestión de compras y contrataciones del ente, como también sobre la ejecución del presupuesto de gastos desde el 10 de diciembre de 2019 hasta la fecha.
- Informar sobre anomalías detectadas junto a su significatividad económica e impacto sobre la gestión.
Se prevé la aplicación de mecanismos para la participación ciudadana en el proceso de adecuación tarifaria transitoria. Se invita a las provincias a coordinar con la Secretaría de Energía las acciones de emergencia correspondientes a la prestación de los servicios de distribución de electricidad en sus jurisdicciones.

National Energy Sector Emergency declared by Executive Order
By Decree of Necessity and Urgency No. 55/2023 (the “Decree”) of December 18, 2023, the President declared the National Emergency of the Energy Sector.
The affected segments are the generation, transport and distribution of electricity under federal jurisdiction and the transport and distribution of natural gas. The emergency period runs until December 31, 2024. The Secretariat of Energy is instructed to prepare and implement a programme of actions that will allow the sanctioning of prices in competition and free access, maintain income levels, cover investment needs and guarantee the continuous provision of public services, in adequate technical and economic conditions, both for providers and users.
It determines the start of the utility rates review and the deadline of December 31, 2024 for the implementation of the new tariffs. In this regard, on December 15, 2023 Resolution No. 704/23 issued by the National Gas Regulatory Agency (ENARGAS, after its Spanish acronym) called for Public Hearing No. 104. The purpose of the hearing is to consider the transitional adjustment of tariffs for the public service of natural gas transportation and distribution of gas through networks, among other issues.
Additionally, the intervention of National Electricity Regulatory Agency (ENRE, after its Spanish acronym) and ENARGAS is ordered by means of the Decree as of January 1, 2024 and until the appointment of the members of the Board of Directors resulting from the corresponding selection processes (Section 8 of the Decree).
The Secretariat of Energy is empowered to designate the ENRE and ENARGAS interventors, who will be required to:
- Report on the fulfilment of the renegotiation processes.
- Carry out the utility rates review processes, and establish transition adjustments and transitory adjustments of tariffs.
- Evaluate and report on the agency’s procurement and contracting management, as well as on the execution of the expenditure budget from December 10, 2019 to date.
- Report on anomalies identified and their economic significance and impact on management.
The implementation of citizen participation mechanisms in the transitory utility rates adjustment process is also contemplated. The provinces are invited to work with the Secretariat of Energy to coordinate emergency actions corresponding to the provision of electricity distribution services in their jurisdictions.
