Foreign Exchange Regulations

El BCRA flexibilizó restricciones aplicables a operaciones con títulos valores, pago de importaciones de bienes y liquidación de exportaciones de servicios

A través de las Comunicaciones “A” 8073 y 8074 de fecha 23 de julio de 2024, el Banco Central de la República Argentina (“BCRA”) modificó las Normas Cambiarias, flexibilizando restricciones aplicables a operaciones con títulos valores, pago de importaciones de bienes y liquidación de exportaciones de servicios.

Operaciones con títulos valores

Se dejó sin efecto, a partir del 24 de julio de 2024, la restricción que aplicaba sobre los sujetos enumerados en el Punto 4.3.2 de las Normas Cambiarias (entre otros, los beneficiarios de ciertas financiaciones especiales, subsidios en las tarifas de gas natural por red, energía eléctrica y/o agua potable, y planes de regularización de deuda previsional) respecto de su capacidad de realizar ciertas operaciones con títulos valores, (entre otras, venta de títulos valores con liquidación en moneda extranjera, transferencia de títulos valores a entidades depositarias en el exterior, adquisición de CEDEARs, entre otros).

Pago de importaciones de bienes

Se mejoraron las condiciones para realizar ciertos pagos de importaciones de bienes oficializadas a partir del 1 de agosto de 2024. En particular, se estableció que (i) el régimen general de pago de importaciones de bienes pasará de 4 cuotas del 25% en 120 días a 2 cuotas del 50% en 60 días; y (ii)  el régimen aplicable para el pago de importaciones de automotores terminados y ciertos bienes específicos (ciertas aeronaves, motocicletas y otros bienes incluidos en el Punto 12.1 de las Normas Cambiarias) pasará de 1 cuota a los 120 días a 1 cuota a los 90 días. En todos los casos los plazos deberán contarse desde el registro de ingreso aduanero de los bienes.

Liquidación de exportaciones de servicios

Se duplicó el monto de moneda extranjera exceptuado de la obligación de liquidación correspondiente a las personas humanas que exportan servicios y cuya actividad se encuentra comprendida  en el Punto 2.2.2.1 de las Normas Cambiarias. Dicho montó pasó de USD 12.000 por año a USD 24.000 por año.

The BCRA relaxed restrictions applicable to transactions with securities, payment of imports of goods and settlement of exports of services

By means of Communications “A” 8073 and 8074 dated July 23, 2024, the Argentine Central Bank (“BCRA”, after its Spanish acronym) amended the Foreign Exchange Regulations, relaxing restrictions applicable to transactions with securities, payment of imports of goods and settlement of exports of services.

Transactions with securities

As from July 24, 2024, the BCRA repealed the restriction applicable to the parties listed in Section 4.3.2 of the Foreign Exchange Regulations (among others, the beneficiaries of certain special financing, subsidies in natural gas, electric power and/or drinking water tariffs, and plans for the regularization of social security debt) with respect to their ability to carry out certain transactions with securities (among others, sale of securities with settlement in foreign currency, transfer of securities to foreign depositories, acquisition of CEDEARs, among others).

Payment of imports of goods

The BCRA improved the conditions for making payments of imports of goods officialized as of August 1st, 2024. In particular, the BCRA established that (i) the general regime for the payment of imports of goods will change from 4 installments of 25% in 120 days to 2 installments of 50% in 60 days; and (ii) the regime applicable to the payment of imports of finished automobiles and certain specific goods (certain aircrafts, motorcycles and other goods included in Section 12.1 of the Foreign Exchange Regulations) will change from 1 installment in 120 days to 1 installment in 90 days. In all cases, the time limits shall be counted as from the date of registration of the customs entry of the goods.

Settlement of exports of services

The BCRA doubled the  amount of foreign currency exempted from the obligation of settlement corresponding to individuals who export services and whose activity is included in Section 2.2.2.1 of the Foreign Exchange Regulations was doubled. Such amount increased from USD 12,000 per year to USD 24,000 per year.
