Se fija la forma de expedir certificados de subdivisión de predios rústicos

Con fecha 23 de julio de 2024, se publicó en el Diario Oficial la Resolución Exenta N° 4.788 del Servicio Agrícola y Ganadero (la “Resolución”), que determina el procedimiento para expedir certificados de subdivisión de predios rústicos y deroga la resolución anterior que regulaba esta materia.

El procedimiento que introduce la Resolución se refiere tanto a la forma en que el Servicio Agrícola y Ganadero deberá recibir, tramitar, custodiar documental y resolver solicitudes de certificación de subdivisión de predios rústicos, como quienes intervienen en dicho procedimiento.

Esta norma aplica a aquellos predios ubicados en el sector rural, esto es, fuera de los límites urbanos o fuera de los límites de los planes reguladores intercomunales de Santiago y Valparaíso y del plan regulador metropolitano de Concepción.

La Resolución comenzará a regir el día 13 de agosto de 2024 por lo que las solicitudes presentadas con anterioridad a esa fecha continuarán rigiéndose por la normativa anterior que regulaba esta materia.

The procedure of issuance of subdivision certificates for rural properties was set

On July 23, 2024, Exempt Resolution No. 4,788 of the Agriculture and Livestock Service (the “Resolution”) was published in the Official Gazette, determining the procedure for issuing subdivision certificates for rural properties and repealing the previous resolution regarding this matter.

The mechanism established by the Resolution refers both to the procedure by which the Agricultural and Livestock Service must receive, process, keep documents, and resolve applications for the certification of subdivision of rural land, as well as those involved in such procedure.

The Resolution applies to those properties located in the rural sector, that is, outside the urban limits or outside the limits of the intercommunal regulatory plans of Santiago and Valparaíso and the metropolitan regulatory plan of Concepción.

The Resolution will become effective as of August 13, 2024. Therefore, applications submitted prior to such date will continue to be governed by the previous regulations regarding this matter.
