La Secretaría de Energía prorroga el plazo de vigencia del RIAIC hasta fines de noviembre
El 23 de noviembre de 2023 se publicó en el Boletín Oficial y entró en vigencia, la Resolución N° 952/2023 de la Secretaría de Energía (la “Resolución” y la “Secretaría”, respectivamente) por medio de la cual la Secretaría prorrogó el plazo de vigencia del Régimen de Incentivos al Abastecimiento Interno de Combustibles (RIAIC).
El régimen creado bajo el Decreto Nº 329/2022 fue restablecido por el Decreto Nº 86/2023 y prorrogado a su vez en el mes de julio por la Resolución Nº 570/2023. El Decreto Nº 461/2023 restableció nuevamente el régimen, comprendiendo las importaciones de naftas y gasoil efectuadas entre el 1° de agosto de 2023 y el 31 de octubre de 2023, reservando la propia Secretaría la autorización de extender el plazo por un mes más.
Se prorroga el plazo de vigencia mediante la Resolución para todas las operaciones de importación de gasoil y/o naftas grado dos o grado tres, realizadas entre el 1 de noviembre y el 30 de noviembre (incluyendo ambas fechas).
Las empresas deberán solicitar adherirse al régimen, y cumplir con los requisitos previstos en los artículos 3 y 4 de la Resolución. La Secretaría verificará la veracidad de la información suministrada por las empresas.
La Secretaría de Energía adjudica los volúmenes de gas natural del Concurso Público Nacional de la Resolución N° 770/2022
El 17 de noviembre de 2023 se publicó en el Boletín Oficial la Resolución N° 944/2023 por medio de la cual la Secretaría de Energía (la “Secretaría”) adjudicó los volúmenes de gas natural previstos en el Concurso Público Nacional del artículo 2, inciso b) de la Resolución N° 770/2022 de la Secretaría.
El Concurso se realizó en el marco del Decreto N° 892/2020, y su modificatorio, Decreto N° 730/2022, donde se aprobó el “Plan de reaseguro y potenciación de la producción federal de hidrocarburos, el autoabastecimiento interno, las exportaciones, la sustitución de importaciones y la expansión del sistema de transporte para todas las cuencas hidrocarburíferas del país 2023-2028”.
Entre los objetivos del Concurso Público, se mencionan:
- Promover la extensión de los compromisos asumidos por aquellos adjudicatarios que realizaron ofertas en las Provincias del Chubut y Santa Cruz en el marco de los procedimientos realizados para el Concurso Público Nacional convocado mediante la Resolución N° 317/2020.
- Promover la presentación de proyectos de Gas Incremental en las Cuencas Austral y Noroeste, bajo la figura de Plan de Actividad Incremental, conforme la definición del Punto 4.26 del Anexo del Decreto N° 892/2020, sustituido por el Decreto N° 730/2022.

The Secretariat of Energy extends the term of validity of the RIAIC until the end of November
By Resolution No. 952/2023 of the Secretariat of Energy (the “Resolution” and the “Secretariat”, respectively) dated November 23, 2023, the Secretariat extended the term of the Incentive Regime for the Internal Supply of Fuels (RIAIC, after its Spanish acronym).
The regime created under Decree No. 329/2022 was re-established by Decree No. 86/2023 and extended in July by Resolution No. 570/2023. Decree Nº 461/2023 re-established the regime again, covering imports of naphtha and diesel oil made between August 1 and October 31, 2023, with the Secretariat itself reserving the authorisation to extend the term for a further month.
The term is extended by the Resolution for all imports of gasoil and/or naphtha grade two or grade three, carried out between November 1 and November 30 (both dates included).
Companies must apply to join the regime and comply with the requirements set forth in Sections 3 and 4 of the Resolution. The Secretariat will verify the veracity of the information provided by the companies.
The Secretariat of Energy awards natural gas volumes under Resolution No. 770/2022
By Resolution No. 944/2023 of November 17, 2023 the Secretariat of Energy (the “Secretariat”) awarded volumes of natural gas under the National Bid Round of Section 2, paragraph b) of Resolution No. 770/2022 of the Secretariat.
The Bid Round was summoned pursuant to Decree No. 892/2020, as amended by Decree No. 730/2022, which approved the “2023-2028 Plan for the reinsurance and enhancement of federal hydrocarbon production, domestic self-supply, exports, import substitution and expansion of the transport system for all hydrocarbon basins in the country”.
The Bid Round mainly sought to:
- Promote the extension of the commitments assumed by those bidders who submitted offers in the Provinces of Chubut and Santa Cruz summoned by Resolution No. 317/2020.
- Promote the presentation of Incremental Gas projects in the Austral and Northwest Basins, within the Incremental Activity Plan, as defined in Point 4.26 of the Annex to Decree No. 892/2020, as replaced by Decree No. 730/2022.
