La Rioja limita las tasas de interés para créditos de consumo y crea un registro de proveedores

El día 25 de agosto de 2026 se publicó en el Boletín Oficial de La Rioja el Decreto N° 1293 mediante el cual se fija un límite a las Tasas de Interés. En efecto, se establece una presunción de abuso cuando la Tasa Nominal Anual (T.N.A.) aplicada supere la tasa máxima para préstamos personales que publica el Banco de la Nación Argentina, indicando que ninguna entidad podrá cobrar un interés por encima de este límite.


Asimismo, se dispone que se consideran como prácticas abusivas prohibidas:

  • Capitalizar intereses fuera de lo permitido por la ley.
  • Exigir la retención de documentos personales (DNI, tarjetas) o claves como garantía.
  • Realizar gestiones de cobranza intimidatorias o vejatorias.
  • Cobrar comisiones o seguros no informados o no solicitados.
La normativa aplica a todas las personas y empresas (incluyendo fintech, plataformas digitales y billeteras virtuales) que ofrezcan créditos de consumo y que no estén reguladas por la Ley Nacional de Entidades Financieras. Y, en este sentido, se crea el “Registro Provincial de Proveedores de Servicios de Crédito para Consumo”, donde deberán inscribirse obligatoriamente todas las entidades alcanzadas por este decreto para poder operar. La falta de inscripción será considerada una infracción formal gravísima.

Finalmente, se declara la “Emergencia Provincial Económica, Crediticia y Social” por 180 días para facilitar la revisión y refinanciación de deudas, protegiendo a los consumidores del sobreendeudamiento, indicándose que durante la emergencia, se suspenden por 180 días las medidas cautelares de embargo y las ejecuciones de sentencias en procesos judiciales iniciados por estas entidades para el cobro de deudas de consumo.

Province of La Rioja caps consumer credit interest rates and creates a registry for service providers

On August 25, 2026, Decree No. 1293 was published in the Official Gazette of La Rioja, establishing limits on interest rates. Specifically, a presumption of abuse is established when the applied Annual Nominal Rate (T.N.A.) exceeds the maximum rate for personal loans published by Banco de la Nación Argentina, providing that no entity may charge interest above this limit.


Additionally, the decree establishes that the following are considered prohibited abusive practices:

  • Capitalizing interest outside legal allowances.
  • Requiring the retention of personal documents (national ID, cards) or passwords as collateral.
  • Conducting intimidating or harassing collection activities.
  • Charging unrequested or undisclosed fees or insurance.
The regulation applies to all individuals and companies (including fintechs, digital platforms, and virtual wallets) that offer consumer credit and are not regulated under the National Financial Entities Law. In this regard, the “Provincial Registry of Consumer Credit Service Providers” is created, where all entities covered by this decree must mandatorily register in order to operate. Failure to register will be considered a very severe formal infraction.

Finally, a “Provincial Economic, Credit, and Social Emergency” is declared for 180 days to facilitate debt review and refinancing, protecting consumers from over-indebtedness. During the emergency, precautionary garnishment measures and the enforcement of judgments in judicial proceedings initiated by these entities for the collection of consumer debts are suspended for 180 days.
