El Poder Ejecutivo Nacional reglamenta el procedimiento sancionatorio para actividades hidrocarburíferas en las Islas Malvinas
El 5 de septiembre de 2026 entró en vigencia el Decreto N° 868/2026 (el “Decreto”), que reglamenta el procedimiento administrativo para sancionar las conductas prohibidas por la Ley N° 26.659 y su modificatoria N° 26.915 (la “Ley”), y modifica la normativa del Régimen de Incentivo para Grandes Inversiones (“RIGI”) y de la Ley de Hidrocarburos N° 17.319 para exigir el cumplimiento de la Ley como condición de acceso a esos regímenes.
La Ley prohíbe a toda persona humana o jurídica, nacional o extranjera, desarrollar actividades hidrocarburíferas participar en ellas, contratarlas o prestar servicios en la Plataforma Continental Argentina, incluidos los espacios marítimos circundantes a las Islas Malvinas, Georgias del Sur y Sandwich del Sur, sin la habilitación de la autoridad argentina competente. Su incumplimiento faculta a sancionar al infractor con una inhabilitación de 5 a 20 años y a exigir la reversión al Estado Nacional o provincial de las concesiones hidrocarburíferas involucradas.
El Decreto designa al Ministerio de Relaciones Exteriores, Comercio Internacional y Culto como Autoridad de Aplicación de la Ley (la “Autoridad”), y establece un procedimiento con plazos acotados: los organismos de la Administración Pública Nacional deberán informarle, dentro de los 5 días hábiles administrativos, cualquier hecho que pudiera configurar una conducta prohibida. Iniciado el sumario, el presunto infractor tendrá 10 días hábiles administrativos para constituir domicilio y presentar su descargo; y la Autoridad deberá dictar resolución fundada dentro de los 10 días hábiles administrativos contados desde la presentación del descargo, desde el vencimiento del plazo para presentarlo, o desde la conclusión de la etapa probatoria, según corresponda.
En materia de RIGI, el Decreto incorpora como requisito de adhesión -nuevo inciso s) del artículo 47 del Anexo I del Decreto N° 749/2024- una declaración jurada suscripta por el representante legal del Vehículo de Proyecto Único (“VPU”) en la que se consigne que ni el VPU, ni las personas humanas o, jurídicas con participación directa o indirecta en él, incurren ni incurrirán en las conductas prohibidas por la Ley. Presentada dicha declaración, la Autoridad de Aplicación del RIGI deberá requerir en todos los casos la intervención previa de la Autoridad -nuevo artículo 52 bis del mismo Anexo-.
En la misma línea, se sustituye el artículo 2 del Anexo I del Decreto N° 1057/2024, de modo que quienes soliciten permisos, concesiones, autorizaciones o habilitaciones bajo el artículo 4 de la Ley de Hidrocarburos N° 17.319 deberán presentar una declaración jurada equivalente, que en el caso de personas jurídicas debe extenderse a quienes tengan participación directa o indirecta en ellas.

The National Executive Branch regulates the sanctioning procedure for hydrocarbon activities in the Malvinas Islands
On September 5, 2026, Decree No. 868/2026 became effective (the “Decree”). The Decree regulates the administrative procedure for sanctioning the conducts prohibited under Law No. 26,659 and its amending Law No. 26,915 (the “Law”), and amends the regulations of the Incentive Regime for Large Investments (“RIGI”) and the Hydrocarbons Law No. 17,319 to require compliance with the Law as a condition for access to those regimes.
The Law prohibits any individual or legal entity, whether domestic or foreign, from carrying out, participating in, contracting for, or rendering services in connection with hydrocarbon activities on the Argentine Continental Shelf, including the maritime areas surrounding the Malvinas Islands, South Georgia, and the South Sandwich Islands, without authorization from the competent Argentine authority. Non-compliance authorizes the imposition of a disqualification of 5 to 20 years on the offender, and the mandatory relinquishment of the hydrocarbon concessions involved to the National State or the relevant province.
The Decree designates the Ministry of Foreign Affairs, International Trade and Worship as the Enforcement Authority under the Law (the “Authority”), and establishes a procedure with defined deadlines: agencies and entities of the National Public Administration must report to the Authority within 5 administrative business days any fact that could constitute a prohibited conduct. Once proceedings are initiated, the alleged offender will have 10 administrative business days to establish a special domicile and file its defense; and the Authority must issue a reasoned decision within 10 administrative business days counted from the filing of the defense, the expiration of the term to file it, or the conclusion of the evidentiary stage, as applicable.
With respect to the RIGI, the Decree adds, as a requirement for admission -new subsection s) of Article 47 of Annex I to Decree No. 749/2024-, a sworn statement executed by the legal representative of the Single Project Vehicle (“SPV”) certifying that neither the SPV nor any individual or legal entity holding a direct or indirect interest therein has engaged, or will engage, in the conduct prohibited under the Law. Once filed, the RIGI Enforcement Authority must, in all cases, request the prior involvement of the Authority -new Article 52 bis of the same Annex-.
Along the same lines, Article 2 of Annex I to Decree No. 1057/2024 is replaced to require that all applicants for permits, concessions, authorizations, or licenses under Article 4 of Hydrocarbons Law No. 17,319 file an equivalent sworn statement, which, in the case of legal entities, must also extend to any individual or legal entity holding a direct or indirect interest therein.
