El BCRA habilitó el acceso al mercado de cambios para aseguradoras locales de proyectos RIGI para el pago de reaseguros en el exterior
A través de la Comunicación “A” 8464 de fecha 6 de agosto de 2026, el Banco Central de la República Argentina (“BCRA”) introdujo modificaciones a las normas sobre “Exterior y Cambios” (las “Normas Cambiarias”) permitiendo el acceso al mercado de cambios (“MLC”) para que las aseguradoras locales efectúen pagos de primas y servicios auxiliares de reaseguros contratados en el exterior, cuando dichos reaseguros estén vinculados a pólizas que cubran riesgos de construcción y operación de un proyecto de un Vehículo de Proyecto Único (“VPU”) en el marco del Régimen de Incentivo para Grandes Inversiones (“RIGI”), sujeto al cumplimiento de determinadas condiciones y requisitos.
Entre otros requisitos, el acceso al MLC estará sujeto a que:
- El acceso de la aseguradora local se realice con fondos transferidos a su cuenta bancaria local por el VPU.
- Dichos fondos provengan: (a) de la liquidación en el MLC de endeudamientos financieros con el exterior y/o emisiones de títulos de deuda, cuyos vencimientos y montos de capital sean compatibles con los previstos en el punto 13.2 de las Normas Cambiarias, o (b) de endeudamientos que encuadren en el punto 1. de la Comunicación “A” 8426 (es decir, como aportes de inversión directa o endeudamientos financieros ingresados y liquidados por otras empresas residentes vinculadas al VPU, en la medida en que dichos fondos pudieran haber sido computados por el VPU de haberlos recibido directamente y sean destinados al financiamiento del proyecto RIGI).
- La porción del endeudamiento utilizada bajo este mecanismo no podrá computarse para otros mecanismos que habiliten el acceso al MLC a partir del ingreso y/o liquidación de dichos fondos.

BCRA authorized access to the FX Market for local insurers of RIGI projects to make payments for reinsurance abroad
By means of Communication “A” 8464 dated August 6, 2026, the Argentine Central Bank (the “BCRA”) amended the “Foreign Exchange” regulations (the “FX Regulations”), allowing access to the foreign exchange market (the “FX Market”) for local insurance companies to make payments of premiums and ancillary reinsurance services contracted abroad, where such reinsurance is related to policies covering construction and operation risks of a project of a Single Project Vehicle (“VPU”) under the Large Investment Incentive Regime (“RIGI”), subject to the satisfaction of certain conditions and requirements.
Among other requirements, access to the FX Market will be subject to the following:
- The local insurance company must access the FX Market with funds transferred to its local bank account by the VPU.
- Such funds must derive from: (a) the settlement in the FX Market of foreign financial indebtedness and/or issuances of debt securities, whose maturity dates and principal amounts are compatible with those set forth in Section 13.2 of the FX Regulations; or (b) indebtedness falling within Section 1 of Communication “A” 8426 (i.e., as direct investment contributions or financial indebtedness received and settled by other resident companies related to the VPU, to the extent that such funds could have been counted by the VPU had they been received directly and are used to finance the RIGI project).
- The portion of the indebtedness used under this mechanism may not be counted for purposes of other mechanisms that allow access to the FX Market based on the inflow and/or settlement of such funds.
