Nueva Guía Técnica para la Capacitación Obligatoria en Prevención de Riesgos Laborales

El 11 de agosto de 2026 se publicó en el Diario Oficial la Resolución Exenta N° 1.117, que aprueba la Guía Técnica para la Capacitación de los Trabajadores en Prevención de los Riesgos Laborales.

La Guía Técnica contiene el marco operativo y técnico para dar cumplimiento a la obligación de capacitación dispuesta en el Decreto Supremo N° 44 (2023), reiterando y estableciendo, entre otros, que la capacitación:

  • Es deber de todo empleador realizarla para sus trabajadores.
  • Debe abordar temas relacionados con riesgos y sus efectos en la salud, medidas preventivas, prestaciones médicas, planes de gestión, etc.
  • Debe tener una duración mínima de 8 horas y realizarse en un plazo máximo de 3 meses.
  • Debe realizarse, al menos, cada dos años.
  • Puede ser ejecutada directamente por el empleador o con la asistencia técnica del Organismo Administrador de la Ley N° 16.744, o a través de Organismos Técnicos de Capacitación (OTEC) acreditados por el SENCE.
La Subsecretaría de Previsión Social pondrá a disposición un curso tipo en su sitio web.

La Guía Técnica incluye un Anexo Metodológico que fija las exigencias técnicas obligatorias para el diseño e implementación de la capacitación.

La Guía Técnica y el Anexo Metodológico entrarán en vigencia el 1 de noviembre de 2026.

New Technical Guide for Mandatory Occupational Risk Prevention Training

On August 11, 2026, Exempt Resolution No. 1,117 was published in the Official Gazette, establishing the Technical Guide for the Training of Workers in Occupational Risk Prevention.


The Technical Guide contains the operational and technical framework to comply with the training obligation set forth in Supreme Decree No. 44 (2023), reiterating and establishing, among other things, that the training:

  • It is the duty of every employer to provide this for their employees.
  • Must address topics related to risks and their effects on health, preventive measures, medical benefits, management plans, etc.
  • Must have a minimum duration of 8 hours and be completed within a maximum period of 3 months.
  • Must be conducted at least every two years.
  • May be executed directly by the employer, with technical assistance from the Administrative Agency for Law No. 16,744, or through Technical Training Organizations (OTECs) accredited by SENCE.
A standard training course will be made available by the Office of Social Welfare on its website.

The Technical Guide includes a Methodological Annex that sets the mandatory technical requirements for the design and implementation of the training.

The Technical Guide and the Methodological Annex will enter into force on November 1, 2026.
