El Poder Ejecutivo de la Provincia de Buenos Aires reglamenta el procedimiento para la renegociación y rescisión de los Contratos de Obra Pública

El 24 de julio de 2026 se publicó en el Boletín Oficial de la Provincia de Buenos Aires y entró en vigencia el Decreto N° 877/2026, mediante el cual se aprobó el “Procedimiento de Renegociación y Rescisión de Contratos de Obra Pública” (el “Procedimiento”), en el marco del estado de emergencia de la situación económica de la Provincia y sus Municipios, declarada mediante Ley Provincial N° 15.557.

El Procedimiento podrá aplicarse a los contratos de obra pública vigentes que generen obligaciones a cargo del Estado provincial y que se encontraran en ejecución al 15 de diciembre de 2025. Podrá iniciarse de oficio o a pedido del co-contratante con la suscripción de un acta de adhesión voluntaria entre las partes y deberá concluir en un plazo máximo de 180 días.

Durante el Procedimiento, la Autoridad Contratante podrá readecuar los plazos de ejecución en función de la disponibilidad de fondos, disponer modificaciones obligatorias de la obra o recontratarla a valores de mercado actualizados.

Si las partes alcanzaran un acuerdo, el Procedimiento concluirá con la suscripción del convenio de renegociación y el dictado del acto administrativo aprobatorio.

La suscripción de dicho convenio exigirá la renuncia expresa del co-contratante a reclamar gastos improductivos, mayores gastos generales u otras compensaciones derivadas de la reducción del ritmo o la paralización de la obra.


La Secretaría de Agricultura, Ganadería y Pesca crea el Sistema Informático de Trazabilidad Animal

El 23 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia la Resolución N° 117/2026 de la Secretaría de Agricultura, Ganadería y Pesca (la “Resolución”), por medio de la cual se creó el “Sistema Informático de Trazabilidad Animal” (el “TRAZA”) en el ámbito de la Subsecretaría de Producción Agropecuaria y Forestal (la “Subsecretaría”).

El TRAZA constituye una herramienta informática de carácter orientativo, de consulta y de aplicación optativa para todos los actores del sector pecuario. Su finalidad es centralizar y ordenar la información disponible en los distintos sistemas informáticos del Estado Nacional sobre la producción primaria de ganados y carnes, abarcando todas las etapas de la cadena productiva, desde la cría hasta la faena.

A través del TRAZA, los actores del sector podrán consultar información sobre sus establecimientos, incluyendo las certificaciones y registros vigentes, el stock de animales por categoría, los números de caravanas vigentes y otros datos relevantes. Asimismo, podrán consultar la cantidad de animales afectados a garantías vigentes y aquellos disponibles para su utilización como garantía, registrar nuevos contratos de warrants y autorizar a los tomadores de esas garantías a acceder a determinada información, entre otras funcionalidades.

La Resolución establece que el uso del TRAZA será optativo para los actores del sector y que su puesta en funcionamiento será paulatina, conforme al avance de su desarrollo informático y a las etapas que determine la Subsecretaría.

The Executive Branch of the Province of Buenos Aires regulates the procedure for the renegotiation and termination of Public Works Contracts

On July 24, 2026, Decree No. 877/2026 of the Province of Buenos Aires was published in the local Official Gazette and entered into force, by means of which the “Procedure for the Renegotiation and Termination of Public Works Contracts” (the “Procedure”) has been approved, in the light of the state of emergency of the economic situation of the Province and its Municipalities, declared by local Law No. 15,557.

The Procedure might be applied to in-force public works contracts with ongoing performance obligations for the Provincial State that were under execution as of December 15, 2025. It may be initiated ex officio or upon the co-contractor’s request through the execution of a voluntary accession agreement, and must be concluded within a maximum period of 180 days.

During the Procedure, the Contracting Authority may adjust execution timelines based on fund availability, order mandatory contract modifications, or re-award the remaining work at updated market values.

If the parties reach an agreement, the Procedure will conclude with the signing of a renegotiation agreement and the issuance of its official approval.

The signing of said agreement will require the co-contractor to expressly waive any claims for idle expenses, increased overheads, or other compensation resulting from the slowdown or suspension of the works.


The Federal Department of Agriculture, Livestock and Fisheries creates the Animal Traceability Computerized System

On July 23, 2026, Resolution No. 117/2026 of the Federal Department of Agriculture, Livestock and Fisheries (the “Resolution”) was published in the Official Gazette and entered into force, by means of which the “Animal Traceability Computerized System” (“TRAZA”) was created under the of Agricultural and Forestry Production Agency (the “Agency”).

TRAZA is an optional, informational and consultative digital tool available to all actors in the livestock sector. Its purpose is to centralize and organize the information available in the different National Government systems regarding primary livestock and meat production, covering all stages of the supply chain, from breeding to slaughter.

Through TRAZA, actors in the livestock sector will be able to access information regarding their establishments, including current certifications and registrations, livestock inventory by category, active tag numbers, and other relevant data. Additionally, they will be able to consult the number of animals subject to existing security interests and those available to be used as collateral, register new warrant agreements, and authorize the holders of such security interests to access certain information, among other functionalities.

The Resolution establishes that the use of TRAZA will be optional for livestock sector actors and that its implementation will be gradual, in accordance with the progress of its software development and the stages determined by the Agency.
