El Poder Ejecutivo Nacional delega en algunas provincias la facultad de concesionar rutas nacionales por peaje

El 18 de abril de 2026 entró en vigencia el Decreto N° 253/2026 (el “Decreto”), mediante el cual el Poder Ejecutivo Nacional delegó en las Provincias de Corrientes, Santa Fe, Córdoba, San Luis, Mendoza, Río Negro, Neuquén, San Juan y Santa Cruz (las “Provincias”) la competencia para el otorgamiento de concesiones de obra pública por peaje para la administración, reparación, ampliación, conservación o mantenimiento de tramos de rutas nacionales emplazados en su territorio, a favor de sociedades privadas o mixtas o entes públicos.

Como consecuencia de la delegación realizada, las Provincias podrán llevar adelante los procesos licitatorios de forma íntegra, desde la aprobación de la documentación licitatoria hasta la adjudicación de los contratos. 

Para ejercer estas competencias, las Provincias deberán suscribir convenios con la Dirección Nacional de Vialidad, que deberán ser aprobados por la Secretaría de Transporte del Ministerio de Economía. Allí deberá establecerse el plazo de la delegación, el cual no podrá ser mayor a 30 años.

A partir de la aprobación del respectivo convenio, las Provincias contarán con el plazo de un año para convocar a licitación, bajo pena de caducidad de la delegación. 

La delegación no implica la transferencia de la titularidad del dominio público ni de la jurisdicción federal sobre los tramos viales involucrados, los que permanecen en cabeza del Estado Nacional. 

El Decreto incorpora la posibilidad de que otras jurisdicciones soliciten su incorporación al régimen indicado.

The National Executive Branch delegates to certain provinces the authority to grant toll concessions for national routes

By means of Decree No. 253/2026 (the “Decree”), effective as of April 18, 2026, the National Executive Branch delegated to the Provinces of Corrientes, Santa Fe, Córdoba, San Luis, Mendoza, Río Negro, Neuquén, San Juan, and Santa Cruz (the “Provinces”) the authority to grant public works toll concessions for the administration, repair, expansion, conservation, or maintenance of national road sections located within their territories. These concessions may be granted to private, mixed-capital, or public entities.

As a consequence of said delegation, the Provinces are authorized to fully manage the corresponding bidding processes, from the approval of tender documentation to the awarding of contracts. 

To exercise these powers, the Provinces must enter into agreements with the National Directorate of Roads, which must be approved by the Federal Department of Transport of the Ministry of Economy. These agreements must establish the term of the delegation, which may not exceed 30 years.

From the approval of the respective agreement, the Provinces shall have a one-year term to call for a tender; under penalty of expiration of the delegation. 

The delegation does not imply the transfer of the ownership of the public domain or federal jurisdiction over the road sections involved, which remain vested in the National State. 

The Decree includes the possibility for other jurisdictions to request their incorporation into the aforementioned regime.
