La Secretaría de Transporte aprueba el nuevo Reglamento de Asignación de Capacidad y Frecuencias para Servicios Aéreos en Aeropuertos de Nivel 2

El 24 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia la Resolución N° 49/2026 de la Secretaría de Transporte, mediante la cual se aprueba el “Reglamento de Asignación de Capacidad y/o Frecuencias para los Servicios Aéreos Nacionales o Internacionales”.


Entre los aspectos más relevantes de la norma destacamos:

  • Régimen Definitivo: Se aprueba formalmente el Reglamento de Asignación de Capacidad y/o Frecuencias, sustituyendo el régimen provisorio de la Resolución N° 43/2025.
  • Declaración Específica: Se ratifica y declara a Aeroparque Jorge Newbery (AEP) como Aeropuerto Facilitado Nivel 2.
  • Carácter Abierto a Futuros Cambios: Los considerandos de la norma aclaran que la medida se dicta “mientras continúa el proceso de evaluación integral” de la información recabada en el esquema provisorio, anticipando la posibilidad de nuevas reformas normativas.
  • Modificaciones Respecto del Reglamento Provisorio Anterior: Si bien el nuevo reglamento contiene algunos cambios respecto del reglamento provisorio anterior, los cambios son sutiles. Los enumeramos a continuación:
  1. Se incorporan nuevas obligaciones para el explotador del aeropuerto.
  2. Se establece de forma expresa que la factibilidad horaria otorgada no constituye un derecho adquirido para el uso de slots, ni confiere propiedad o derecho subjetivo sobre mangas, puertas, posiciones o mostradores.
  3. Se aclara que la prioridad para retener horarios de una temporada a otra solo alcanzará a los servicios “efectivamente operados”. Se priva de prioridad a los recursos aeroportuarios que hayan sido retenidos, bloqueados o no utilizados efectivamente por el transportador (principio contra el acaparamiento de capacidad).
  4. Se define de manera expresa qué constituye el “uso indebido” de horarios o recursos.

The Federal Department of Transportation approves the new Regulations on Capacity and Frequency Allocation for Air Services at Level 2 Airports

On July 24, 2026, Resolution No. 49/2026 of the Federal Department of Transportation was published in the Official Gazette and entered into force, approving the “Regulations on Capacity and/or Frequency Allocation for Domestic or International Air Services”.


Among the most relevant aspects of the regulation, the following stand out:

  • Definitive Regime: The Regulations on Capacity and/or Frequency Allocation are formally approved, replacing the provisional regime established under Resolution No. 43/2025.
  • Specific Declaration: Aeroparque Jorge Newbery (AEP) is formally declared and ratified as a Level 2 Facilitated Airport.
  • Open to Future Amendments: The preamble of the regulation clarifies that the measure is enacted “while the comprehensive evaluation process continues” regarding information gathered under the provisional scheme, anticipating the possibility of future regulatory reforms.
  • Modifications Regarding the Previous Provisional Regulations: While the new regulations introduce subtle modifications compared to the previous provisional scheme, the key changes include:
  1. New obligations are established for the airport operator.
  2. It is expressly stated that the granted time feasibility does not constitute an acquired right to use slots, nor does it confer ownership or subjective rights over jetways, gates, parking positions, or check-in counters.
  3. It clarifies that priority to retain schedules from one season to the next will only apply to services “actually operated”. Airport resources that have been retained, blocked, or not actually used by the carrier are deprived of priority (anti-capacity hoarding principle).
  4. An express definition of what constitutes “improper use” of schedules or resources is established.
