La Secretaría de Industria, Comercio y de la Pequeña y Mediana Empresa reglamenta la emisión digital de la Declaración de Origen para exportaciones al Mercosur

El 23 de julio de 2026 se publicó en el Boletín Oficial la Resolución N° 247/2026 de la Secretaría de Industria, Comercio y de la Pequeña y Mediana Empresa, mediante la cual se regula el procedimiento para la emisión de la Declaración de Origen como prueba alternativa en el ámbito del Mercosur.


Sus principales disposiciones son:

  • Emisión y firma: Se gestionará a través de la plataforma "Trámites a Distancia" (TAD) con firma digital o electrónica del productor o exportador. Revestirá carácter de declaración jurada y no implicará aprobación previa o evaluación por parte de la Administración Pública.
  • Plazos y validez: Deberá emitirse dentro de los 180 días corridos contados desde la fecha de la factura comercial y tendrá una validez de 12 meses desde su generación.
  • Obligación de conservación: El declarante deberá conservar todos los antecedentes y registros respaldatorios (costos, compras de materiales, procesos de producción) por un término mínimo de 5 años.
  • Régimen sancionatorio: Ante el incumplimiento de formalidades o del origen declarado, la Dirección de Importaciones podrá aplicar sanciones de suspensión para emitir declaraciones de origen por hasta 18 meses, o inhabilitación de hasta 5 años en casos de reincidencia o actuación fraudulenta.
  • Facultades de inspección: Se faculta a la Dirección de Importaciones a solicitar  información y/o documentación vinculada a la Declaración de Origen del exportador o productor, así como también a realizar visitas de inspección de oficio a los establecimientos involucrados como parte de sus tareas ordinarias de control.
La medida entrará en vigor el 26 de septiembre de 2026.

The Department of Industry, Commerce and Small and Medium Enterprises regulates the digital issuance of the Declaration of Origin for exports to Mercosur

On July 23, 2026, Resolution No. 247/2026 of the Federal Department of Industry, Commerce and Small and Medium Enterprises was published in the Official Gazette, regulating the procedure for issuing the Declaration of Origin as an alternative proof of origin within Mercosur.

Its main provisions are:

  • Issuance and signature: It will be processed through the “Trámites a Distancia” (TAD) platform with the digital or electronic signature of the producer or exporter. It will have the status of a sworn statement and will not require prior approval or evaluation by the Public Administration.
  • Terms and validity: It must be issued within 180 calendar days from the date of the commercial invoice and will be valid for 12 months from its generation.
  • Record-keeping obligation: The declarant must retain all supporting documentation and records (costs, purchase of materials, production processes) for a minimum term of 5 years.
  • Penalty regime: In the event of non-compliance with formalities or the declared origin, the Import Directorate may impose penalties of suspension from issuing declarations of origin for up to 18 months, or disqualification for up to 5 years in cases of recurrence or fraudulent conduct.
  • Inspection powers: It authorizes the Import Directorate to request information and/or documentation related to the producer's or exporter's Declaration of Origin, as well as to conduct ex officio inspection visits to the involved facilities as part of its routine oversight duties.
The measure will enter into force on September 26, 2026.
