La Secretaría de Energía simplifica la inscripción registral de operadores de Gas Licuado de Petróleo Automotor y Náutico

El 28 de julio de 2026 se publicó en el Boletín Oficial la Resolución N° 180/2026 de la Secretaría de Energía (la “Resolución”) que modifica las Resoluciones N° 131/2003, 136/2003 y 339/2021, en el marco del proceso de desregulación iniciado por los Decretos N° 70/2023 y N° 90/2025.


La Resolución sustituye la exigencia de presentar copia certificada de la habilitación municipal como requisito de inscripción en el Registro Nacional de la Industria del Gas Licuado de Petróleo (RNIGLP) y en el Registro Nacional de Operadores de la Industria del Gas Licuado de Petróleo Automotor (RNOIGLPA), por la presentación de una declaración jurada mediante la cual el interesado manifiesta que el establecimiento cumple con las condiciones de seguridad, salubridad, ambientales y de emplazamiento exigidas por la normativa municipal y provincial aplicable.

El cambio alcanza a los operadores de Gas Licuado de Petróleo Automotor (GLPA) y de Gas Licuado de Petróleo Náutico (GLPN), así como a talleres de montaje, centros de revisión y rehabilitación de tanques, talleres de reparación de válvulas, garajes y playas de estacionamiento.

La Resolución aclara expresamente que la simplificación documental no implica una eliminación de los controles locales: el inicio de actividades continúa supeditado a la autorización municipal o provincial correspondiente, cuando la normativa aplicable así lo exija. Asimismo, se incorpora en los textos modificados que la aprobación otorgada por la Subsecretaría de Hidrocarburos no podrá interpretarse como una habilitación integral, siendo responsabilidad exclusiva de cada operador el cumplimiento de la normativa nacional, provincial y municipal correspondiente.

Se mantiene inalterada la obligación de contar con la certificación de cumplimiento de las condiciones de seguridad emitida por una Empresa Auditora de Seguridad registrada ante la Secretaría de Energía, requisito indispensable para la aprobación técnica de las instalaciones.

Por último, la norma exceptúa de la presentación de la declaración jurada a los operadores inscriptos como Importador (IM) que no manipulen Gas Licuado Petróleo en ninguna de sus etapas, y a los inscriptos como Comercializador (CO) y Consumidor Independiente (CI).


La Secretaría de Energía crea el Registro de Operaciones de Exportación y aprueba el nuevo Procedimiento para la Exportación de Hidrocarburos Líquidos y sus Derivados

El 22 de julio de 2026 se publicó en el Boletín Oficial la Resolución N° 166/2026 de la Secretaría de Energía (la “Resolución”), que creó el Registro de Operaciones de Exportación y aprobó el Procedimiento para la Exportación de Hidrocarburos Líquidos y sus Derivados (el “Procedimiento”), aplicable a los aceites crudos de petróleo, los aceites crudos de mineral bituminoso, las gasolinas (excepto las de aviación), el gasoil, el propano, el butano y el Gas Licuado de Petróleo en mezcla.

El Procedimiento deroga el esquema de oferta previa al mercado interno (Resoluciones N° 241/2017 y 175/2023) y lo reemplaza por un procedimiento único de notificación-objeción, alineado con el principio de libre exportación de la Ley N° 27.742 y el Decreto N° 70/2023.

El interesado debe notificar la exportación completando la información pertinente (datos del producto, precio, volumen, período, punto de exportación, país de destino y disponibilidad proyectada) a través de la plataforma Trámites A Distancia (TAD), la cual reviste carácter de declaración jurada.

Para las Exportaciones de Largo Plazo, aquellas de más de 12 meses consecutivos, se exige además, según el producto, la presentación de los contratos comerciales vinculados y la acreditación de disponibilidad de producción (reservas propias o contratos con productores), así como información sobre paradas de planta programadas en el caso de Gas Licuado de Petróleo, propano y butano. En contratos de más de 60 meses consecutivos, se requiere volver a acreditar disponibilidad cada 3 años.

El interesado debe declarar bajo juramento que tiene asegurada la capacidad de transporte necesaria, y cuando la exportación requiera nueva infraestructura, deberá acreditar la consistencia técnica, localización y financiamiento del proyecto, salvo que ya cuente con adhesión al Régimen de Incentivo para Grandes Inversiones (RIGI).

La Subsecretaría de Hidrocarburos en su carácter de autoridad de aplicación (la “Autoridad”), puede requerir aclaraciones dentro de los 5 días hábiles de recibida la notificación, y objetar la exportación, total o parcial, únicamente por causales vinculadas a la falta de disponibilidad de hidrocarburos para el  abastecimiento del mercado interno, la falta de acreditación de reservas o disponibilidad, la inexactitud de la información respaldatoria de la operación, prácticas anticompetitivas, variaciones imprevistas en precios de mercado interno o falta de proporcionalidad entre proyecciones informadas y seguridad de suministro al mercado interno.

El plazo máximo para objetar contados a partir de la notificación de exportación es  de 30 días hábiles para crudo, gasolina, gasoil y 7 días hábiles para propano, butano  y Gas Licuado de Petróleo. Notificada la objeción, el interesado cuenta con 5 días hábiles para presentar descargo o proponer subsanación, sobre lo cual la Autoridad debe expedirse en un plazo máximo de 15 días hábiles; la omisión de descargo habilita la caducidad del procedimiento.

Vencidos los plazos sin objeción, o subsanada esta, la Autoridad emite la Constancia de Libre Exportación (la “Constancia”) dentro de los 5 días, documento que otorga estabilidad a la exportación notificada y habilita el despacho ante la Agencia de Recaudación y Control Aduanero. Es importante destacar que el silencio de la administración tiene sentido positivo. El titular debe informar modificaciones sustanciales a la operación y mantener vigente su registro. La Constancia puede ser cedida con conformidad previa de la Autoridad, y puede revocarse por incumplimiento de estas obligaciones, inexactitud de la información declarada o incumplimiento material de sus términos, mediando siempre intimación previa de 10 días hábiles para subsanar o formular descargo.

The Federal Department of Energy simplifies registration for Automotive and Marine Liquefied Petroleum Gas Operators

Resolution No. 180/2026 of the Federal Department of Energy of July 28, 2026 (the “Resolution”), amended Resolutions No. 131/2003, 136/2003 and 339/2021, within the framework of the deregulation process initiated by Decrees No. 70/2023 and No. 90/2025.


The Resolution replaces the requirement to submit a certified copy of the municipal permit as a condition for registration in the National Registry of the Liquefied Petroleum Gas Industry (RNIGLP) and in the National Registry of Automotive Liquefied Petroleum Gas Operators (RNOIGLPA), with the submission of a sworn statement whereby the applicant declares that the facility complies with the safety, health, environmental and siting conditions required under applicable municipal and provincial regulations.

The change applies to Automotive Liquefied Petroleum Gas and Marine Liquefied Petroleum Gas operators, as well as to assembly workshops, tank inspection and rehabilitation centers, valve repair shops, garages and parking lots.

The Resolution expressly clarifies that this documentary simplification does not entail the elimination of local controls: the commencement of activities remains subject to the corresponding municipal or provincial authorization, where applicable regulations so require. In addition, the amended provisions now expressly state that the approval granted by the Hydrocarbons Agency may not be construed as a comprehensive authorization, and that each operator remains solely responsible for compliance with applicable national, provincial and municipal regulations.

The obligation to hold a safety compliance certification issued by a Safety Auditing Company registered with the Department of Energy remains unchanged, and continues to be an essential requirement for the technical approval of facilities.

Finally, the sworn statement requirement shall not apply to operators registered as Importers (IM) that do not handle Liquified Petroleum Gas at any stage, as well as operators registered as Marketers (CO) and Independent Consumers (CI).


The Federal Department of Energy creates the Export Operations Registry and approves the new Procedure for the Export of Liquid Hydrocarbons and their Derivatives

Resolution No. 166/2026 of the Federal Department of Energy of July 22, 2026 (the “Resolution”) created the Export Operations Registry and approved the Procedure for the Export of Liquid Hydrocarbons and their Derivatives (the “Procedure”), applicable to crude petroleum oils, crude bituminous mineral oils, gasoline (other than aviation gasoline), gasoil, propane (crude and other), butane, and Liqueified Petroleum Gas blend.

The Procedure abrogates the former domestic market pre-offer regime (Resolutions No. 241/2017 and 175/2023) and replaces it with a single notification-objection procedure, in line with the free export principle set forth in Law No. 27,742 and Decree No. 70/2023.

The applicant must notify the export by submitting the relevant information (product data, price, volume, period, export point, destination country, and projected availability) through the Remote Procedures Platform (Trámites A Distancia, TAD), which has the status of a sworn statement.

For Long-Term Exports, defined as those exceeding 12 consecutive months, applicants must additionally submit, depending on the product, the relevant commercial contracts and evidence of production availability (own reserves or contracts with producers), as well as information on scheduled plant shutdowns in the case of Liquefied Petroleum Gas, propane, and butane. For contracts exceeding 60 consecutive months, availability must be re-accredited every 3 years.

Applicants must declare under oath that the necessary transport capacity has been secured, and where the export requires new infrastructure, must demonstrate the technical consistency, location, and financing structure of the project, unless the applicant has already been admitted to the Incentive Regime for Large Investments (RIGI).

The Hydrocarbons Agency, acting as enforcement authority (the “Authority”), may request clarifications within 5 business days of receiving the notification, and may object to the export, in whole or in part, solely on grounds relating to a lack of hydrocarbon availability for supplying the domestic market, failure to evidence reserves or availability, inaccuracy of the information supporting the operation, anticompetitive practices, unforeseen fluctuations in domestic market prices, or a lack of proportionality between the projections submitted and domestic market supply security.

The maximum term to raise an objection, counted from the export notification, is 30 business days for crude oil, gasoline, and gasoil, and 7 business days for propane, butane, and Liquefied Petroleum Gas. Once notified of an objection, the applicant has 5 business days to file a response or propose a remedy, on which the Authority must rule within a maximum of 15 business days; failure to file a response triggers the applicable rules on lapse of administrative proceedings.

Once the deadlines have expired without objection, or any objection has been remedied, the Authority will issue the Free Export Certificate (the “Certificate”) within 5 days; this document grants stability to the notified export and enables customs clearance before the Customs Collection and Control Agency. Notably, the administration's silence is deemed a positive response. The certificate holder must report any material changes to the operation and keep its registration current. The Certificate may be assigned with the Authority's prior consent, and may be revoked for failure to comply with these obligations, inaccuracy of the information declared, or material breach of its terms, always subject to prior notice of 10 business days to remedy or file a response.
