La Superintendencia de Seguros de la Nación regula la contratación y comercialización de los seguros paramétricos

El 23 de julio de 2026 se publicó en el Boletín Oficial y entró en vigencia la Resolución Sintetizada N° 315/2026, mediante la cual la Superintendencia de Seguros de la Nación (“SSN”) incorporó el punto 23.8 al Reglamento General de la Actividad Aseguradora (“RGAA”), fijando el marco regulatorio para los Seguros Paramétricos.


Entre los aspectos más relevantes de la norma destacamos:

  • Definición: Se define como aquel seguro en el cual, ante la ocurrencia del riesgo o evento contemplado, la indemnización se activa y paga al alcanzarse el valor de un índice predeterminado, sin exigencia de probar la existencia o el monto de los daños.
  • Prohibición: Se prohíbe expresamente la comercialización de coberturas de Seguros de Personas bajo esta modalidad.
  • Régimen de autorización: Exige aprobación de carácter particular con estudio técnico de factibilidad e índice validado por actuario independiente inscripto en la SSN (sin autorización tácita). Se permite el uso compartido de planes autorizados entre entidades previa conformidad expresa del titular.
  • Excepción para Sector Público y Grandes Tomadores: Se autoriza la comercialización sin autorización previa cuando el tomador sea el Estado (Nacional, Provincial o Municipal) o cuando las sumas aseguradas superen 1.000.000 de Unidades de Valor Adquisitivo (UVA). En estos casos, las aseguradoras deberán informar las pólizas a la SSN dentro de los 30 días de su emisión.
  • Impacto para el análisis legal: Previsibilidad y reducción drástica de la litigiosidad contractual por eliminación de peritajes y disputas sobre la cuantía del daño; y dinamización comercial de coberturas complejas de gran escala.

The National Insurance Superintendency regulates the contracting and commercialization of parametric insurance

On July 23, 2026, Summarized Resolution No. 315/2026 was published in the Official Gazette and entered into force, through which the National Insurance Superintendency (“SSN”) incorporated item 23.8 into the General Regulations on Insurance Activity (“RGAA”), establishing the regulatory framework for Parametric Insurance.


Among the main highlights of the regulation, the following stand out:

  • Definition: It is defined as an insurance policy in which, upon the occurrence of the covered risk or event, the indemnity is triggered and paid when a predetermined index value is reached, without requiring proof of the existence or amount of damages.
  • Prohibition: The commercialization of Life and Personal Insurance coverage under this modality is expressly prohibited.
  • Authorization Regime: It requires specific individual approval supported by a technical feasibility study and an index validated by an independent actuary registered with the SSN (no tacit authorization). Shared use of authorized plans among entities is permitted subject to the express prior consent of the holder.
  • Exception for the Public Sector and Large Policyholders: Commercialization without prior authorization is permitted when the policyholder is the State (National, Provincial, or Municipal) or when the sums insured exceed 1,000,000 Purchasing Value Units (UVA). In these cases, insurers must report the policies to the SSN within 30 days of issuance.
  • Legal Impact: Predictability and a drastic reduction in contractual litigation due to the elimination of expert appraisals and disputes over damage assessment; and commercial dynamization of large-scale complex coverage.
