El Gobierno otorga urgencia al proyecto de ley que crea el contrato por horas

El 9 de junio de 2026, el Gobierno otorgó urgencia al proyecto de ley que modifica el Código del Trabajo para incorporar el denominado “Contrato por Horas”. La iniciativa busca otorgar mayor flexibilidad laboral, permitiendo pactar una jornada de trabajo por horas; estas no deben exceder de 30 horas semanales o de 120 horas mensuales.


Entre sus principales aspectos, el proyecto contempla:

  • La obligación que el contrato de trabajo indique las horas contratadas, su distribución semanal o mensual y la forma y anticipación para requerir el servicio.
  • La posibilidad de distribuir la jornada diaria de forma continua o discontinua, asegurando un descanso mínimo de 12 horas continuas en un periodo de 24 horas.
  • El derecho del trabajador a recibir, al menos, el 75% del valor de las horas pactadas aun cuando se hubieren requerido menos horas de trabajo.
  • La presunción de contratación en jornada completa, cuando no se cumplan los requisitos legales de este tipo de contratos.

Government grants urgent status to bill introducing hourly employment contracts

On June 9, 2026 the government granted urgent status to the bill amending the Labor Code to incorporate the so-called “Hourly Contract”. The initiative seeks to provide greater labor flexibility by allowing work schedules to be agreed upon in hours; these must not exceed 30 hours per week or 120 hours per month.


Among its main features, the bill includes:

  • The requirement that the employment contract specify the contracted hours, their weekly or monthly distribution and the procedure and notice period for requesting the employee's services.
  • The possibility to schedule the daily workday continuously or discontinuously, ensuring a minimum rest period of 12 consecutive hours over a period of 24 hours.
  • The employee's right to receive at least 75% of the value of the agreed hours, even if fewer hours of work were required.
  • The presumption of full-time employment when the legal requirements for this type of contract are not met.
