El Poder Ejecutivo Nacional reglamenta el Régimen de Incentivo a la Formalización Laboral

El 4 de mayo de 2026 se publicó en el Boletín Oficial el Decreto N° 315/2026 (el “Decreto”) por medio del cual se reglamenta el Título XX de la Ley  N° 27.802 de Modernización Laboral, que había establecido la creación del Régimen de Incentivo a la Formalización Laboral (“RIFL”).

Cabe recordar que el RIFL está orientado a reducir la informalidad y a promover la creación de nuevo empleo registrado, de aplicación a contrataciones que impliquen aumento neto de personal, de aplicación a desempleados recientes, monotributistas y ex empleados públicos.

En concreto, contempla la reducción de las contribuciones patronales por el término de 48 meses contados desde el inicio de la relación laboral. Dichas contribuciones se adecuarán a una alícuota del 2% total con destino al Sistema Integrado Previsional Argentino (SIPA), al Fondo Nacional de Empleo y al Régimen Nacional del Asignaciones Familiares, y una alícuota del 3% con destino al Subsistema de la Seguridad Social regido por la Ley N° 19.032 (INSSJP).

El Decreto establece que se consideran nuevas incorporaciones las que se inicien y registren ante la Agencia de Recaudación y Control Aduanero (“ARCA”) entre el 1 de mayo de 2026 y el 30 de abril de 2027, ambas fechas inclusive.

Se dispone que aquellos que hubieran adquirido el carácter de empleador inscripto a partir del 10 de diciembre de 2025 podrán incluir relaciones laborales en el RIFL hasta un máximo del 80% de su nómina de trabajadores.

Asimismo, se aclara que los trabajadores comprendidos son aquellos que no hayan contado con una relación laboral registrada al 10 de diciembre de 2025, o que previo al mes del alta laboral hayan estado desempleados en los últimos 6 meses, o hayan estado inscriptos en el Régimen Simplificado para Pequeños Contribuyentes, o cuyo último empleo haya sido bajo relación de dependencia en el sector público nacional, provincial, municipal o de la Ciudad Autónoma de Buenos Aires.

Por otro lado, el 5 de mayo de 2026 se publicó en el Boletín Oficial la Resolución General ARCA N° 5844/2026 estableciendo las formas, los plazos y las condiciones para ejercer la opción al régimen y usufructuar el mencionado beneficio de reducción de alícuotas, así como el procedimiento aplicable para el ingreso de las obligaciones derivadas de su incumplimiento.

The National Executive Power regulates the Labor Formalization Incentive Regime

On May 4, 2026, Decree No. 315/2026 (the “Decree”) was published in the Official Gazette, regulating Title XX of the Labor Modernization Law No. 27,802, which established the creation of the Labor Formalization Incentive Regime (“RIFL”).

The RIFL is aimed at reducing informality and promoting the creation of new registered employment. It applies to hirings that result in a net increase in staff and targets recently unemployed individuals, small taxpayers (monotributistas), and former public sector employees.

Specifically, it provides for a reduction in employer contributions for a term of 48 months starting from the commencement of the employment relationship. These contributions will be adjusted to a 2% total rate allocated to the Argentine Integrated Pension System (SIPA), the National Employment Fund, and the National Family Allowance Regime, and a 3% rate allocated to the Social Security Subsystem governed by Law No. 19,032 (INSSJP).

The Decree establishes that new hires are those initiated and registered with the Agency of Collection and Customs Control (“ARCA”) between May 1, 2026, and April 30, 2027, inclusive.

It is further provided that those who acquired the status of registered employer as of December 10, 2025, may include employment relationships in the RIFL up to a maximum of 80% of their total workforce.

Furthermore, the Decree clarifies that the eligible workers are those who did not have a registered employment relationship as of December 10, 2025, or who were unemployed during the 6 months prior to the date of hire, or who were registered under the Simplified Tax Regime for Small Taxpayers (Monotributo), or whose last employment was under a dependency relationship in the national, provincial, or municipal public sector, or within the City of Buenos Aires.

Additionally, on May 5, 2026, ARCA General Resolution No. 5,844/2026 was published in the Official Gazette, establishing the forms, deadlines, and conditions to exercise the option for the regime and utilize the aforementioned contribution reduction benefit, as well as the procedure applicable for the payment of obligations arising from non-compliance.
