El INPI agiliza el trámite de patentes mediante el reconocimiento de búsquedas internacionales

El 14 de mayo de 2026 entró en vigencia la Resolución N° 142/2026 del Instituto Nacional de la Propiedad Industrial  (la “Resolución” y el  “INPI”, respectivamente), que tiene como objetivo primordial reducir los plazos de concesión de patentes de invención y modelos de utilidad, atacando el stock de trámites pendientes.

 

A continuación, se destacan los puntos fundamentales de la Resolución:
  • Reconocimiento de búsqueda internacional: Se faculta a los titulares de solicitudes de patentes a solicitar la aplicación de los términos de la Resolución P-056/2016. Esto permite que el INPI utilice los informes de búsqueda y exámenes de fondo realizados por otras oficinas de patentes extranjeras, agilizando el examen local.
  • Oportunidad procesal ampliada: A diferencia del esquema anterior, los solicitantes ahora pueden invocar este beneficio en cualquier etapa del trámite, siempre que no se haya dictado la resolución final (concesión o denegatoria).
  • Reducción de carga administrativa: La medida busca evitar la duplicación de esfuerzos en el examen de novedades y mérito inventivo cuando estos ya han sido validados por oficinas internacionales de referencia, alineando el procedimiento local con estándares de eficiencia globales.
La Resolución es aplicable tanto a nuevas solicitudes como a aquellas que se encuentran actualmente en curso, brindando una herramienta de celeridad para los expedientes demorados.

INPI streamlines patent prosecution through the recognition of international searches

On May 14, 2026, Resolution No. 142/2026 of the National Institute of Industrial Property (the “Resolution” and “INPI”, respectively) entered into force. Its primary objective is to reduce the timeframes for granting patents and utility models, thereby tackling the backlog of pending applications.


The fundamental points of the Resolution are highlighted below:

  • Recognition of international searches: Patent applicants are empowered to request the application of the terms of Resolution P-056/2016. This allows INPI to utilize prior search reports and substantive examinations conducted by foreign patent offices, thereby accelerating the local examination process.
  • Expanded procedural opportunity: Unlike the previous framework, applicants can now invoke this benefit at any stage of the prosecution, provided that a final resolution (grant or rejection) has not yet been issued.
  • Reduction of administrative burden: The measure seeks to avoid the duplication of efforts in the examination of novelty and inventive steps when these have already been validated by international offices of reference, aligning local procedures with global efficiency standards.
The Resolution is applicable to both new applications and those currently in progress, providing a fast-track tool for delayed files.
