Fallo de la la Cámara Nacional de Apelaciones en lo Comercial confirma la responsabilidad objetiva y solidaria frente al consumidor de quienes hayan puesto la marca en el producto o servicio 

La Sala A de la Cámara Nacional de Apelaciones en lo Comercial (la “Cámara”) confirmó el fallo de primera instancia en la causa “B., J. A. c. Cordial Cía. Financiera S.A. y otro s/ordinario”, en la que se discutía si un hipermercado (Walmart) debía responder por el incumplimiento de la entidad financiera (Cordial), emisora de una tarjeta de crédito que llevaba la marca Walmart. 

La Cámara confirmó que Walmart es responsable (solidario y objetivo) y para ello consideró el vínculo comercial entre las demandadas en relación al contrato de tarjeta de crédito, en cuanto dicho producto se ofrecía en un espacio cedido por Walmart y la tarjeta llevaba la marca Walmart. 

Así, consideró que los perjuicios generados al consumidor por el accionar de Cordial en relación al contrato de tarjeta de crédito, en el cual Walmart puso su marca, no puede ser denominado como ajeno a este último. Ello, por aplicación de los artículos 13 y 40 de la Ley N° 24.240 de Defensa del Consumidor que establecen la responsabilidad objetiva y solidaria frente al consumidor de todos aquellos que intervienen en la cadena de valor del producto o servicio, o que hayan puesto su marca en el producto o servicio.

Ruling from the National Chamber of Appeals in Commercial Matters sets the joint and several liability of those that contributed  its brand to the services or goods

Panel A of the National Chamber of Appeals in Commercial Matters (the “Chamber”) upheld the first instance ruling in the case “B., J. A. v. Cordial Cía. Financiera S.A. y otro s/ordinario”, in which the main issue was whether the hypermarket (Walmart) should be liable for the breach of the financial entity (Cordial) in issuing a credit card bearing the Walmart brand. 

The Chamber confirmed that Walmart is responsible (jointly and strictly) by considering the commercial agreements between the defendants in relation to the credit card contract, as well as  that said product was offered in a physical space provided by Walmart and the credit card bore the Walmart brand. 

Hence, it considered that the damages caused to the consumer by Cordial's actions in relation to the credit card contract, in which Walmart contributed its brand, cannot be considered as unrelated to the latter. This, by application of Sections 13 and 40 of the Consumer Protection Law No. 24,240, that establish the strict and joint responsibility towards the consumer of all those who intervene in the chain of commercialization of the product or service, or who contribute its brand.
