Se reglamenta la Ley de Promoción de la Alimentación Saludable

El 23 de marzo de 2022 se publicó en el Boletín Oficial el Decreto N° 151/2022 (el “Decreto”) que reglamenta la Ley de Promoción de la Alimentación Saludable N° 27.642, divulgada como “Ley de Etiquetado”.

En términos generales, el Decreto:

  • Instaura un régimen especial para rótulos litografiados y/o pintados que implica la posibilidad de colocar un microsello.
     
  • Aprueba las especificaciones técnicas que deberán cumplir los sellos de advertencias (octógonos) y las leyendas precautorias (cafeína y edulcorantes).
     
  • Determina los puntos de corte para los nutrientes críticos (azúcares añadidos, grasas saturadas, grasas totales y sodio) y/o edulcorantes y/o cafeína y/o calorías, diferenciando dos etapas con valores críticos diferentes.
     
  • Fija una primera etapa con umbral de nutrientes críticos más bajos y una segunda etapa con umbrales más altos a cumplirse a los 9 meses y 18 meses respectivamente de la entrada en vigencia de la Ley de Etiquetado. El plazo de implementación es mayor para PyMES, cooperativas en el mercado de economía popular y proveedores del sector de la agricultura familiar.
     
  • Establece la definición de “azúcares” diferenciando los azúcares totales de los añadidos.
     
  • Establece cuándo se considerará agregado de azúcares, grasas y sodio.
     
  • Dispone la definición de “publicidad y promoción”.
     
  • Brinda la definición de los sujetos obligados, indicando que alcanza a todas las personas públicas y privadas, con o sin fines de lucro, extendiendo asimismo el concepto a aquellas personas que integren la cadena de valor. Los locales comerciales o puntos de venta, sea de forma física como en línea, quedan también comprendidos.
     
  • Define a los fines de la Ley de Etiquetado, los conceptos “asociaciones civiles o sociedades científicas”, “personajes infantiles” y “celebridades”.
     
  • Fija a la Administración Nacional de Medicamentos, Alimentos y Tecnología Médica (ANMAT) como órgano de control de la Ley de Etiquetado.

Law No. 27,642 on the Promotion of Healthy Eating is regulated

On March 23, 2022, Decree No. 151/2022 (the "Decree") regulating the Promotion of Healthy Eating Law No. 27,642, known as the "Labeling Law", was published in the Official Gazette.

In general terms, the Decree:

  • Sets a special regime for lithographed and/or painted labels with the possibility of placing a micro-seal.
     
  • Approves the technical specifications that the warning seals must comply with as well as the precautionary wordings (caffeine and sweeteners).
     
  • Determines the cut-off points for critical nutrients (added sugars, saturated fats, total fats and sodium) and/or sweeteners and/or caffeine and/or calories, differentiating two stages with different critical values.
     
  • Sets a first stage with lower critical nutrient thresholds and a second stage with higher thresholds to be met 9 months and 18 months respectively after the entry into force of the Labeling Law. The implementation period is longer for PyMES, cooperatives in the popular economy market and suppliers of the family farming sector.
     
  • Establishes the definition of "sugars" differentiating total sugars from added sugars.
     
  • Establishes when sugars, fats and sodium will be considered as added.
     
  • Provides the definition of "advertising and promotion".
     
  • Provides the definition of the obligated entities: all public and private persons, whether profit or not for profit, as well as those that participate in the value chain. Commercial premises or points of sale, whether physical or online, are also included.
     
  • Defines for the purposes of the Labeling Law, the concepts "civil associations or scientific societies", "children's characters" and "celebrities".
     
  • Establishes the National Administration of Medicines, Food and Medical Technology (ANMAT) as the controlling body of the Labeling Law.
