Cálculo de intereses en juicios laborales

El 14 de marzo de 2024 la Cámara Nacional de Apelaciones del Trabajo (“CNAT”) dictó la Resolución de Cámara N° 3 (la “Resolución”) relacionada con el cálculo de intereses en los juicios laborales. 

La Resolución se genera a partir del fallo dictado por la Corte Suprema de Justicia de la Nación el pasado 29 de febrero de 2024 en el caso “Recurso de hecho deducido por la demandada en la causa Oliva, Fabio Omar c/ COMA S.A. s/ despido”. 

En el mencionado precedente, el Máximo Tribunal dispuso dejar sin efecto un pronunciamiento de la CNAT que, aplicando el criterio del Acta N° 2764 (vigente desde septiembre de 2022) había dispuesto la capitalización anual de intereses desde la fecha de notificación de la demanda, lo que elevaba desproporcionadamente los importes originalmente reclamados en la demanda.

Ahora, la CNAT, tomando en consideración lo señalado anteriormente, dispuso: (1) como recomendación, que se adecuen los créditos laborales sin tasa legal, de acuerdo a la tasa CER (Coeficiente de Estabilización de Referencia) reglamentada por el BCRA más una tasa pura del 6% anual, en ambos casos, desde la fecha de exigibilidad del crédito hasta la fecha del efectivo pago; y (2) que la única capitalización del artículo 770, inciso b, del Código Civil y Comercial de la Nación se produce a la fecha de notificación de la demanda exclusivamente sobre la tasa pura del 6% anual.

Entendemos que la Resolución resulta poco clara y se presta a múltiples interpretaciones que podrían dar resultados concretos muy distintos entre sí. Por ello, y más allá del dictado de la Resolución, entendemos que la CNAT deberá expedirse nuevamente en pos de aclarar el nuevo mecanismo de actualización a aplicarse a los juicios laborales.

Calculation of interests in labor lawsuits

On March 14, 2024, the National Labor Chamber of Appeals (“CNAT” after its Spanish acronym) issued Chamber Resolution No. 3 (the “Resolution”) related to the calculation of interests in labor lawsuits.

The Resolution arises from the ruling issued by the Supreme Court of Justice of the Nation on February 29, 2024, in the case “Appeal brought by the defendant in the case Oliva, Fabio Omar vs. COMA S.A. on dismissal”.

In the aforementioned precedent, the Supreme Court ordered to invalidate a decision of the CNAT which, applying the criteria of Act No. 2764 (in force since September 2022), had ordered the annual capitalization of interests from the date of notification of the lawsuit, disproportionately raising the amounts originally claimed in the lawsuit.

Now, the CNAT, taking into consideration the aforementioned, has decided: (1) as a recommendation, to adjust labor credits without legal rate, according to the CER rate (“Coeficiente de Estabilización de Referencia”) regulated by the BCRA plus a pure rate of 6% annually, in both cases, from the date of enforceability of the credit until the date of actual payment; and (2) that the only capitalization provided in Section 770, Article b, of the Civil and Commercial Code of the Nation occurs on the date of notification of the lawsuit exclusively on the pure rate of 6% annually.

We understand that the Resolution is unclear and lends itself to multiple interpretations that could lead to very different concrete results. Therefore, and beyond the issuance of the Resolution, we understand that the CNAT will need to express itself again in order to clarify the new mechanism of updating to be applied to labor lawsuits.
