Modificaciones al régimen de contrataciones del sector público de la Provincia de Buenos Aires

Las principales modificaciones que se introdujeron por medio del Nuevo Reglamento son las siguientes:

  1. El Nuevo Reglamento incluyó en su ámbito de aplicación a los contratos celebrados bajo la vigencia de la Ley provincial N° 14.806, Nº 14.812, Nº 14.815, y N° 15.165 que regularon la declaración del estado de  emergencia en materia de seguridad pública, política y salud penitenciaria; infraestructura, hábitat, vivienda y servicios públicos; administrativa y tecnológica; y social, económica, productiva y energética en el ámbito de la provincia de Buenos Aires, como así también la prestación de los servicios y la ejecución de los contratos a cargo del sector público provincial, centralizado, descentralizado, organismos autónomos, autárquicos, de la Constitución.
  2. El Nuevo Reglamento limitó la renegociación de los contratos a una única vez durante su vigencia y sus prórrogas.
  3. Se estableció que la renegociación afectará los montos no ejecutados de los contratos al momento de la solicitud. Los montos ejecutados con posterioridad a la solicitud de renegociación estarán alcanzados por el resultado de esta.
  4. Se previó que al solicitar una renegociación y/o rescisión de un contrato, el cocontratante deberá demostrar que la afectación de las obligaciones en curso de ejecución es superior al 15% de la ecuación económica financiera del contrato (en el procedimiento anterior el monto  afectado de la ecuación económica financiera del contrato debía ser del 10%).
  5. Se eliminó que la propuesta de renegociación por parte la autoridad convocante no podía prever una adecuación de prestaciones y/o montos contratados mayor al 35%.
  6. En el caso de que el cocontratante rechace la renegociación contractual y solicite la rescisión del contrato por la parte del contrato sin ejecutar, la solicitud deberá justificarse de la forma que lo prevé  el Nuevo Reglamento en sus artículos 6, 7 y 10.

Amendment to the contracting regime of the public sector of the Province of Buenos Aires

The main amendments introduced by the New Regulations are as follows:

  1. The New Regulation includes the contracts signed under the validity of Provincial Acts No. 14,806, No. 14,812, No. 14,812, No. 14,815, and No. 15,165 that regulate the declaration of a state of emergency in matters of public safety, penitentiary policy and health; infrastructure, habitat, housing and public services; administrative and technological; and social, economic, productive and energy matters in the province of Buenos Aires, as well as the rendering of services and the execution of contracts in charge of the provincial public sector, centralized, decentralized, autonomous, autarchic and constitutional bodies.
  2. The New Regulations limited the renegotiation of contracts to a single time during their term and their extensions.
  3. It was established that the renegotiation will affect the unexecuted amounts of the contracts at the time of the request. The amounts executed after the request for renegotiation will be covered by the result of the renegotiation.
  4. It was provided that when requesting a renegotiation and/or termination of a contract, the co-contractor must demonstrate that the impact of the obligations in progress exceeds 15% of the economic-financial equation of the contract (in the previous procedure the amount affected of the economic-financial equation of the contract had to be 10%).
  5. The requirement that the proposal for renegotiation by the bidding authority could not foresee an adjustment of services and/or amounts contracted in excess of 35%, was eliminated. 
  6. In the event that the co-contractor rejects the contract renegotiation and requests the termination of the contract for the unexecuted portion of the contract, the request must be justified in the manner provided for in Sections 6, 7 and 10 of the New Regulations.
