Creación del “Sistema Nacional de Trazabilidad de Productos Fitosanitarios” del SENASA

El 12 de julio de 2021 se publicó en el Boletín Oficial la Resolución N° 369/2021 del Servicio Nacional de Sanidad y Calidad Agroalimentaria (la “Resolución” y el “SENASA”, respectivamente) mediante la cual se crea el “Sistema Nacional de Trazabilidad de Productos Fitosanitarios” (el “Sistema”) con la finalidad de identificar los productos fitosanitarios y los distintos actores del Sistema, así como también georreferenciar cada uno de los depósitos de productos fitosanitarios y geolocalizar los productos fitosanitarios a través de toda la cadena de distribución hasta el usuario final.

La Resolución es de aplicación obligatoria para todos aquellos que importen, exporten, sinteticen, formulen, fraccionen, distribuyan, comercialicen, depositen y/o ejerzan la tenencia (los “Actores”), con cualquier fin, de productos fitosanitarios inscriptos en el Registro Nacional de Terapéutica Vegetal del SENASA. Sólo estarán exceptuadas de su alcance los productos “Línea jardín”.

La Resolución establece varias obligaciones para todos los Actores entre las que se destacan, principalmente, las siguientes:

- Darse de alta y operar en el Sistema. 

- Declarar y mantener actualizado un listado de los lugares físicos donde depositan sus productos fitosanitarios.

- Declarar todas las operaciones de:

  • importación, síntesis, formulación y fraccionamiento en un plazo de 72 horas;
  • comercialización y/o distribución y exportación de productos fitosanitarios en tiempo real en que el actor realice la operación;
  • movimiento de productos fitosanitarios que se realice entre depósitos, por quien origina el movimiento y confirmado por quien lo recibe;
  • entregas que se hagan a los usuarios finales; y
  • uso propio de productos fitosanitarios.

Por otro lado, la Resolución establece la obligación de todos aquellos que sean titulares de registros de productos fitosanitarios trazables (principios activos y/o productos formulados) de identificarlos por medio de un código unívoco de respuesta rápida (Quick Response code -Código QR-) de conformidad con las exigencias dispuestas en dicha norma.

Este Sistema reemplaza el “Sistema de Trazabilidad de Productos Fitosanitarios y Veterinarios” establecido por la Resolución Nº 369/2013 del SENASA; cuya información será migrada al nuevo Sistema, la que deberá ser validada por los Actores en un plazo de 30 días hábiles contabilizados desde el 20 de septiembre de 2021.

The National Service of Health and Food Quality created the “National Traceability System for Phytosanitary Products” 

On July 12, 2021, Resolution No. 369/2021 of the National Service of Health and Food Quality (the “Resolution” and the “SENASA”, respectively) was published in the Official Gazette. 

The Resolution created the “National Traceability System for Phytosanitary Products” (the “System”). The System purpose is to identify phytosanitary products and those who operate them, as well as to geo-reference each of the product warehouses and to geo-locate the products through the whole distribution chain to the end-user.

The Resolution is enforceable on those who import, export, synthesize, formulate, fractionate, distribute, commercialize, deposit and/or hold phytosanitary products registered in the “National Register of Plant Therapeutics” of SENASA (hereinafter “Subjects”). Only “Garden Line” products are exempted from this regulation.

The main obligations set in the Resolution are:

- To register and operate in the System. 

- To declare and keep updated a list of the physical places where they deposit their phytosanitary products.

- To declare all operations regarding:

  • import, synthesis, formulation and fractionation within 72 hours;
  • sale and/or distribution and export of products in real time in which the Subject carries out the operation;
  • movement of products between warehouses, by the originator of the movement and confirmed by the recipient;
  • deliveries to end-users; and
  • own use of products.

The Resolution also established the obligation of all those who are holders of registrations of traceable phytosanitary products (active ingredients and/or formulated products) to identify them by means of an univocal Quick Response code (QR Code) in accordance with the requirements set out in the aforementioned regulation.

The System replaced the “Traceability System of Phytosanitary and Veterinary Products” established by SENASA by means of Resolution No. 369/2013. Due to this replacement, all information will be migrated to the new System and must be validated by the Subjects within 30 business days counted as from September 20, 2021.
