Se publica Ley que modifica regularización de la posesión de la pequeña propiedad raíz

El 24 de noviembre de 2023 se publicó en el Diario Oficial la Ley N° 21.633 que regula los delitos de ocupación ilegal de inmuebles, fija nuevas penas y formas comisivas e incorpora mecanismos eficientes de restitución.

La mencionada ley surge como respuesta a las usurpaciones y tomas de propiedades en el país y a los intentos de regularizar la posesión de la pequeña propiedad raíz por parte de los usurpadores, con el fin de adquirirlas por prescripción ordinaria en el plazo de 5 años. 

La pequeña propiedad raíz consiste en aquellos bienes raíces rurales o urbanos cuyo avalúo fiscal sea inferior a 800 o 380 unidades tributarias, respectivamente. 

Debido a esto, se establecen, por un lado, nuevas penas y formas de usurpación y, por el otro, a través de modificaciones al Decreto Ley N° 2.695, se impide la regularización de la posesión de la pequeña propiedad raíz, y por tanto la oportunidad de adquirir el dominio de la propiedad por prescripción ordinaria, en tanto se acredite la inexistencia de juicios pendientes o sentencias condenatorias respecto del delito de usurpación en contra del solicitante. 

El cumplimiento de este último requisito se realizará mediante la presentación de un certificado emitido por el Conservador de Bienes Raíces, en conjunto con una declaración jurada.

Además, se incorpora una presunción de dolo en caso que se obtenga el reconocimiento de posesión regular mientras existiere juicio pendiente o sentencia condenatoria por el delito de usurpación en contra del solicitante, ya sea sobre todo el inmueble o parte de este.

Law that modifies the regularization of the possession of small real estate property is published

On November 24, 2023, Law No. 21,633, which regulates the crimes of illegal occupation of real estate, establishes new penalties and forms of commission, and incorporates efficient restitution mechanisms, was published in the Official Gazette.

The aforementioned law arises as a response to the usurpations and seizures of properties in the country and the attempts to regularize the possession of small real estate by the usurpers, in order to acquire these properties by ordinary statute of limitations in the term of 5 years.

Small real estate consists of rural or urban real estate whose taxable value is less than 800 or 380 tax units, respectively.

Due to this, on the one hand, new penalties and forms of usurpation are established and, on the other hand, through amendments to Decree Law No. 2,695, the regularization of the possession of small real estate is prevented as long as there is no evidence of pending lawsuits or convictions for the crime of usurpation against the applicant.

Compliance with this last requirement will be made by filing a certificate issued by the Real Estate Registry, together with an affidavit.

In addition, a presumption of fraud is incorporated in the event that recognition of regular possession is obtained while there is a pending trial or conviction for the crime of usurpation against the applicant, either on all or part of the property.
