Modificación a la Ley N° 19.537 sobre Copropiedad Inmobiliaria

Con fecha 26 de enero de 2022, se remitió al Presidente de la República el proyecto de Ley aprobado por el Congreso que modifica la Ley sobre Copropiedad Inmobiliaria. A continuación se indican algunos de los cambios introducidos por el proyecto:

  • Modificación de las exigencias para la constitución de regímenes de copropiedad.
     
  • Creación del Registro Nacional de Administradores de Condominios a cargo del Ministerio de Vivienda y Urbanismo, en el cual deberán inscribirse todas las personas naturales o jurídicas que ejerzan la actividad de administradores de condominios.
     
  • Creación de una Secretaría Ejecutiva de Condominios, encargada de impartir instrucciones para la aplicación de esta Ley; mantener actualizado el Registro Nacional de Administradores de Condominios; implementar la política habitacional y desarrollo de viviendas sociales, entre otras funciones.
     
  • Procedencia de la acción de nulidad absoluta en contra de las disposiciones de los reglamentos de copropiedad que no se ajusten a la Ley.
     
  • Nuevas exigencias para la construcción de condominios, y entre ellas, la prohibición de acceder a la copropiedad a través de servidumbres.

Amendment to Law No. 19,537 on Real Estate Co-ownership 

On January 26, 2022, the bill approved by Congress amending the Law on Real Estate Co-ownership was delivered to the President of the Republic for enactment. Find below the most important changes introduced by the bill:

  • The requirements to create co-ownership were modified.
     
  • Creation of the National Registry of Condominium Administrators in charge of the Ministry of Housing and Urban Development, in which all natural or legal persons who exercise the activity of condominium administrators must register.
     
  • Creation of an Executive Department of Condominiums, in charge of issue instructions for the application of this Law; keep the National Registry of Condominium Administrators updated; implement housing policy and development of social housing, among other functions.
     
  • Application of the absolute nullity action against the provisions of the co-ownership regulations that do not comply with the Law.
     
  • New requirements for the construction of condominiums, and among them, the prohibition of access to co-ownership through easements.
