Proyecto de ley tratamiento de datos personales

El 25 de enero de 2022 el Senado dio su aprobación al proyecto de ley que regula la protección y tratamiento de los datos personales y crea la Agencia de Protección de Datos Personales, despachando el proyecto a la Cámara de Diputados, pasando así a segundo trámite constitucional. 

Este proyecto de ley viene a modificar sustancialmente la Ley N° 19.628 que actualmente regula la protección de datos personales, creando por ejemplo, una autoridad autónoma de derecho público, de carácter técnico, descentralizado, con personalidad y jurídica y patrimonio propio, denominada Agencia de Protección de Datos Personales que tendrá por objeto velar por la efectiva protección de los datos personales. 

Adicionalmente, refuerza e incorpora nuevos derechos para los titulares de datos personales, como el derecho a la portabilidad y crea categorías especiales de datos para su regulación especial (salud, perfil biológico humano, datos personales de niños, niñas y adolescentes, entre otros).

También este proyecto de ley viene a regular la transferencia internacional de datos personales, cuestión que no se encuentra regulada en la legislación actual e incorpora un régimen general de responsabilidad, que incluye infracciones divididas en leves, graves y gravísimas, y sanciones desde 1 a 10.000 UTM.

Personal data processing bill

On January 25, 2022, the Senate gave its approval to the bill that regulates the protection and treatment of personal data and creates the Agency for the Protection of Personal Data, dispatching the project to the Chamber of Deputies, thus passing to the second constitutional procedure. 

This bill substantially modifies Law No. 19,628, which currently regulates the protection of personal data, creating, for example, an autonomous authority of public law, of technical nature, decentralized, with personality and legal status and its own assets, called Agencia de Protección de Datos Personales, that will aim to ensure the effective protection of personal data.

Additionally, it reinforces and incorporates new rights for the holders of personal data, such as the right to portability and creates special categories of data for its special regulation (health, human biological profile, personal data of children and teenagers, among others).

This bill also comes to regulate the international transfer of personal data, an issue that is not regulated in current legislation, and incorporates a general liability regime, which includes infractions divided into minor, serious and very serious, and sanctions ranging from 1 to 10,000 UTM.
