Obligatoriedad del “PASE LIBRE COVID” para el transporte de pasajeros en la Provincia de Buenos Aires
El 27 de enero de 2022 se publicó en el Boletín Oficial de la Provincia de Buenos Aires la Resolución de Firma Conjunta N° 1/2022 del Ministerio de Salud y el Ministerio de Transporte de la Provincia (la “Resolución”), a través de la cual se establece la obligatoriedad del “PASE LIBRE COVID” para el servicio de transporte de pasajeros en la Provincia de Buenos Aires.
La Resolución se aplica a todas las personas mayores de trece años, que utilicen servicios públicos de transporte de pasajeros por automotor, de carácter regular y/o especializado, aledaños a la CABA (de media distancia) y servicios interurbanos y/o rurales de larga distancia.
El usuario obtiene el “PASE LIBRE COVID” mediante la aplicación de al menos dos dosis de la vacuna contra COVID-19. Puede ser acreditado mediante las aplicaciones “VacunatePBA”, “Mi Argentina”, o por el carnet de vacunación en formato cartón o tarjeta.
Las empresas concesionarias o permisionarias de servicios públicos de jurisdicción provincial controlarán el cumplimiento del “PASE LIBRE COVID” en forma previa al inicio del servicio.

Nuevos requisitos sanitarios para el ingreso al país
El 26 de enero de 2022 se publicó en el Boletín Oficial la Decisión Administrativa N° 63/2022 que modifica los requisitos sanitarios para el ingreso a la República Argentina.
Así, la norma establece los siguientes requisitos sanitarios:
Extranjeros no residentes
- Con esquema de vacunación completo:
- Deben consignar en la declaración jurada exigida por la Dirección Nacional de Migraciones que han completado el esquema de vacunación al menos 14 días antes de su ingreso al país.
- Deben contar con una prueba de PCR negativa realizada en el país de origen dentro de las 72 horas previas al inicio del viaje o una prueba de antígeno realizada en el país de origen dentro de las 48 horas previas al inicio del viaje.
- Deben portar consigo las constancias de la vacunación y del test para exhibir a los operadores de transporte y las autoridades.
- Deben poseer un seguro de salud COVID-19.
- Las personas vacunadas y con test negativo estarán eximidas de realizar cuarentena.
- Con esquema de vacunación incompleto o no vacunadas:
- Deben tramitar la excepción de vacunación ante la autoridad competente (en el caso de que se reúnan las condiciones y los requisitos definidos por la autoridad sanitaria nacional para la excepción).
- Deben contar con una prueba de PCR negativa realizada en el país de origen dentro de las 72 horas previas al inicio del viaje o una prueba de antígeno realizada en el país de origen dentro de las 48 horas previas al inicio del viaje.
- Deben portar consigo las constancias de la excepción y del test para exhibir a los operadores de transporte y las autoridades.
- Deben poseer un seguro de salud COVID-19.
- Las personas con esquema de vacunación incompleto o no vacunadas (salvo por los menores de edad) deberán realizar cuarentena de 7 días contados a partir del día siguiente a la toma de la prueba PCR o antígeno.
Argentinos y residentes en la República Argentina
- Con esquema de vacunación completo:
- Deben consignar en la declaración jurada exigida por la Dirección Nacional de Migraciones que han completado el esquema de vacunación al menos 14 días antes de su ingreso al país.
- Deben portar consigo la constancia de la vacunación para exhibir a los operadores de transporte y las autoridades.
- Las personas vacunadas estarán eximidas de realizar cuarentena.
- Con esquema de vacunación incompleto o no vacunadas:
- Deben contar con una prueba de PCR negativa realizada en el país de origen dentro de las 72 horas previas al inicio del viaje o una prueba de antígeno realizada en el país de origen dentro de las 48 horas previas al inicio del viaje.
- Deben portar consigo la constancia del test para exhibir a los operadores de transporte y las autoridades.
- Las personas con esquema de vacunación incompleto o no vacunadas (salvo por los menores de edad) deberán realizar cuarentena de 7 días contados a partir del día siguiente a la toma de la prueba PCR o antígeno.
Extranjeros provenientes de países limítrofes o residentes de dichos países, siempre que hubieran permanecido allí al menos los últimos 14 días
- Con esquema de vacunación completo:
- Deben consignar en la declaración jurada exigida por la Dirección Nacional de Migraciones que han (i) completado el esquema de vacunación al menos 14 días antes de su ingreso al país; y (ii) permanecido por lo menos los últimos 14 días antes de su ingreso al país en el país limítrofe.
- Las personas vacunadas estarán eximidas de realizar cuarentena.
- Con esquema de vacunación incompleto o no vacunadas:
- Deben tramitar la excepción de vacunación ante la autoridad competente (en el caso de que se reúnan las condiciones y los requisitos definidos por la autoridad sanitaria nacional para la excepción).
- Deben contar con una prueba de PCR negativa realizada en el país de origen dentro de las 72 horas previas al inicio del viaje o una prueba de antígeno realizada en el país de origen dentro de las 48 horas previas al inicio del viaje.
- Deben portar consigo las constancias de la excepción y del test para exhibir a los operadores de transporte y las autoridades.
- Deben poseer un seguro de salud COVID-19.
- Las personas con esquema de vacunación incompleto o no vacunadas (salvo por los menores de edad) deberán realizar cuarentena de 7 días contados a partir del día siguiente a la toma de la prueba PCR o antígeno.
Menores de edad
- Los menores de edad que no hayan completado el esquema de vacunación estarán eximidos en todos los casos de realizar cuarentena. No obstante, se recomienda que no realicen actividades grupales ni concurran a eventos grupales o masivos durante los primeros 7 días contados desde su arribo al país.
- Los menores de 6 años de edad están además eximidos en todos los casos de practicarse la prueba PCR o de antígenos para su ingreso al país.
Asimismo, se autoriza el ingreso en vehículos particulares de argentinos y residentes vacunados con esquema completo y que sean casos positivos que ya hayan completado 7 días de aislamiento desde la fecha de inicio de síntomas o la fecha de toma de muestra de prueba diagnóstica laboratorial. El ingreso en vehículo de transporte de pasajeros se autoriza a partir de cumplidos los 10 días de aislamiento desde la fecha de inicio de síntomas o la fecha de toma de muestra de prueba diagnóstica laboratorial.
También podrán ingresar en vehículos particulares argentinos y residentes que sean contactos estrechos vacunados asintomáticos. Mientras que los contactos estrechos asintomáticos no vacunados que ingresen por ese medio deberán completar su aislamiento en el país.
Finalmente, se determina que para el embarque en cruceros internacionales solo se admitirá la presentación de prueba diagnóstica PCR negativa realizada hasta 72 horas previas al embarque, cualquiera sea la nacionalidad del pasajero o tripulante. Asimismo, se cumplirá con las previsiones establecidas por la Decisión Administrativa Nº 1316/21 para el manejo de casos y rastreo de contactos.
La norma entró en vigencia el 29 de enero de 2022.

“PASE LIBRE COVID” ('FREE PASS COVID') is mandatory for the transport of passengers in the Province of Buenos Aires
On January 27, 2022, Joint Resolution No. 1/2022 set by the Ministry of Health and Ministry of Transportation of the Province (the “Resolution”) was published in the Official Gazette of the Province of Buenos Aires.
The Resolution establishes the obligation to any older of thirteen years old to exhibit the “PASE LIBRE COVID” certificate as a condition for using automobile public passenger transportation services, whether regular and/or specialized, nearby the City of Buenos Aires (medium distance) and long distance intercity and/or rural services.
In order to travel, the passenger must prove by means of “VacunatePBA” or “Mi Argentina” applications, or with the vaccination card in paperboard or card format that he/she has applied at least two doses of the COVID-19 vaccine.
Concessionaires or permit holders companies of public services of provincial jurisdiction will control that passengers comply with the respective “PASE LIBRE COVID”.

New health requirements for entering the country
On January 26, 2022, Administrative Decision No. 63/2022 (the “Decision”) was published in the Official Gazette, modifying the health requirements for entering Argentina.
The Decision establishes the following health requirements:
Foreigners who do not reside in Argentina
- With complete vaccination schedule:
- They must state in the affidavit required by the National Directorate of Migration that they have completed the vaccination schedule at least 14 days before entering the country.
- They must have a negative PCR test carried out in the country of origin within 72 hours before the start of the trip or an antigen test carried out in the country of origin within 48 hours before the start of the trip.
- They must carry with them the proof of vaccination and testing to show to transport operators and authorities.
- They must have COVID-19 health insurance.
- Vaccinated people with a negative test will be exempt from quarantine.
- With incomplete vaccination schedule or not vaccinated:
- They must apply for the vaccination exception before the competent authority (in the event that the conditions and requirements defined by the national health authority for the exception are met).
- They must have a negative PCR test carried out in the country of origin within 72 hours before the start of the trip or an antigen test carried out in the country of origin within 48 hours before the start of the trip.
- They must carry with them the proof of the exception and the test to show to the transport operators and the authorities.
- They must have COVID-19 health insurance.
- People with an incomplete vaccination schedule or unvaccinated (except for minors) must self-quarantine for 7 days from the day after taking the PCR for antigen test.
Argentines and people residing in Argentina
- With complete vaccination schedule
- They must state in the affidavit required by the National Directorate of Migration that they have completed the vaccination schedule at least 14 days before entering the country.
- They must carry with them the proof of vaccination to show to transport operators and authorities.
- Vaccinated people will be exempt from quarantine.
- With incomplete vaccination schedule or not vaccinated:
- They must have a negative PCR test carried out in the country of origin within 72 hours before the start of the trip or an antigen test carried out in the country of origin within 48 hours before the start of the trip.
- They must carry with them the proof of the test to show to the transport operators and the authorities.
- People with an incomplete vaccination schedule or unvaccinated (except for minors) must self-quarantine for 7 days from the day after taking the PCR or antigen test.
Foreigners from neighboring countries or residents of said countries, provided they have stayed there for at least the last 14 days
- With complete vaccination schedule:
- They must state in the affidavit required by the National Directorate of Migration that they have (i) completed the vaccination schedule at least 14 days before entering the country; and (ii) spent at least the last 14 days before entering the country in the neighboring country.
- Vaccinated people will be exempt from quarantine.
- With incomplete vaccination schedule or not vaccinated:
- They must apply for the vaccination exception before the competent authority (in the event that the conditions and requirements defined by the national health authority for the exception are met).
- They must have a negative PCR test carried out in the country of origin within 72 hours before the start of the trip or an antigen test carried out in the country of origin within 48 hours before the start of the trip.
- They must carry with them the proof of the exception and the test to show to the transport operators and the authorities.
- They must have COVID-19 health insurance.
- People with an incomplete vaccination schedule or unvaccinated (except for minors) must self-quarantine for 7 days from the day after taking the PCR for antigen test.
Minors
- Minors who have not completed the vaccination schedule will be exempt from quarantine, in all cases. However, it is recommended that they do not carry out group activities or attend group or massive events during the first 7 days counted from their arrival in the country.
- Children under 6 years of age are also exempted from the PCR or antigen test to enter the country, in all cases.
Likewise, the entry in private vehicles of Argentines and residents vaccinated with a complete schedule and that are positive cases of COVID-19 that have already completed 7 days of quarantine from the date of onset of symptoms or the date of taking a laboratory diagnostic test sample is authorized. The entry in a passenger transport vehicle is authorized after 10 days of quarantine have been completed from the date of onset of symptoms or the date of taking a laboratory diagnostic test sample.
Argentines and residents who are asymptomatic vaccinated close contacts of a COVID-19 diagnosed person will be able to enter the country in private vehicles. While unvaccinated asymptomatic close contacts who enter in private vehicles must complete their quarantine in the country.
Finally, it is established that for embarkation on international cruises, only the presentation of a negative PCR diagnostic test carried out up to 72 hours prior to embarkation will be accepted, regardless of the nationality of the passenger or crew member. Likewise, compliance with the provisions established by Administrative Decision No. 1316/21 for case management and contact tracing will be verified.
The Decision entered into force on January 29, 2022.
