Servicio de transporte no físico de hidrocarburos líquidos
El 23 de agosto de 2021 se publicó en el Boletín Oficial el Decreto Nº 540/2021 (el “Decreto”), el cual implementó el servicio de transporte no físico de hidrocarburos líquidos por ductos hasta la brida de ingreso a la planta de almacenamiento (el “Servicio”). Ver el Decreto en el link.
Se entiende por transporte no físico al servicio por el cual el cargador entrega hidrocarburos líquidos en un determinado punto de carga y solicita la devolución de una cantidad de hidrocarburos líquidos equivalente en un punto de devolución distinto al o a los puntos de devolución establecidos según el normal y habitual sentido del flujo o desplazamiento del crudo, dentro del ámbito de una única concesión de transporte.
El Decreto prevé que el cargador podrá solicitar y el transportista deberá implementar el Servicio, en tanto las condiciones técnicas y operativas de su sistema de transporte lo permitan, y procederá a la devolución del volumen recibido, en la medida que la cantidad equivalente de hidrocarburos líquidos se encuentre disponible en el punto de entrega solicitado.
En el cumplimiento del Servicio el cargador deberá observar las especificaciones técnicas y devolver al cargador los volúmenes de hidrocarburos líquidos recibidos en el punto de entrega acordado, corregidos por los factores de calidad y las deducciones volumétricas establecidas en el Anexo I de la Resolución Nº 571/2019 de la Secretaría de Energía (la “Resolución”). El transportista podrá establecer un cargo administrativo de gestión por el Servicio que no formará parte de la tarifa y será solventado por el cargador que solicita la implementación del Servicio.

Swap (Non-physical Transportation) Service for Liquid Hydrocarbons
Decree No. 540/2021 of August 23, 2021, (the “Decree”) established the non-physical transportation service of liquid hydrocarbons through pipelines to the storage plant entrance flange (the “Service”). Click on this link to see the Decree in Spanish.
Non-physical transportation is understood as the service through which the shipper delivers liquid hydrocarbons at a certain loading point against the return of an equivalent quantity of liquid hydrocarbons at a return point other than the return point or points established according to the normal and usual flow direction or movement of crude oil, within the range of a single transportation concession.
The Decree establishes that the carrier must implement the Service upon the shipper’s request, subject to technical and operational conditions in the transportation system allow it, and shall proceed to return the volumen received, to the extent an equivalent quantity of liquid hydrocarbons is available at the requested delivery point.
In the performance of the Service the shipper shall observe the technical specifications and return the liquid hydrocarbons quantities corrected by the quality and volumetric factors set forth in Annex I of Resolution No. 571/2019 of the Energy Secretariat (the “Resolution"). The carrier may establish an administrative management fee for the Service, which shall not be part of the tariff and shall be borne by the shipper requesting the Service.
